General recommendation XXVIII on the follow-up to the World Conference against Racism, Racial Discrimination, Xenophobia and Related Intolerance	第二十八号一般性建议：反对种族主义、种族歧视、仇外心理和相关不容忍现象世界会议的后续行动

The Committee on the Elimination of Racial Discrimination,	消除种族歧视委员会，
Welcoming the adoption of the Durban Declaration and Programme of Action of the World Conference against Racism, Racial Discrimination, Xenophobia and Related Intolerance and the provisions of General Assembly resolution 56/266 which endorse or are designed to ensure the follow-up of those instruments,	欢迎反对种族主义、种族歧视、仇外心理和相关不容忍现象世界会议的《德班宣言和行动纲领》得到通过以及大会第56/266号决议核可或用作旨在确保按这些文书开展后续行动的各项规定；
Welcoming the fact that the instruments adopted at Durban strongly reaffirm all the fundamental values and standards of the International Convention on the Elimination of All Forms of Racial Discrimination,	对在德班通过的各项文书强烈重申《消除一切形式种族歧视国际公约》的所有根本价值和标准表示欢迎；
Recalling that the Durban Declaration and Programme of Action refer to the International Convention on the Elimination of All Forms of Racial Discrimination as the principal instrument to combat racism, racial discrimination, xenophobia and related intolerance,	忆及《德班宣言和行动纲领》将《消除一切形式种族歧视国际公约》作为打击种族主义、种族歧视、仇外心理和相关不容忍现象的主要文书；
Noting in particular the affirmation in the Durban Declaration that universal adherence to and full implementation of the International Convention on the Elimination of All Forms of Racial Discrimination are of paramount importance for promoting equality and non-discrimination in the world,	尤其注意到《德班宣言》重申普遍遵守和全面执行《消除一切形式种族歧视国际公约》对于在世界上促进平等消除歧视极其重要；
Expressing its satisfaction at the recognition of the role and contribution of the Committee to the struggle against racial discrimination,	对承认委员会在与种族歧视现象作斗争中所发挥的作用和所作出的贡献表示满意；
Conscious of its own responsibilities in the follow-up to the World Conference and of the need to strengthen its capacity to undertake these responsibilities,	意识到委员会本身在世界会议后续行动中的职责以及加强其履行这些职责的能力的必要性；
Stressing the vital role of non-governmental organizations in the struggle against racial discrimination and welcoming their contribution during the World Conference,	强调非政府组织在与种族歧视现象作斗争中的关键作用，并对非政府组织在世界会议中所作出的贡献表示欢迎；
Taking note of the recognition by the World Conference of the important role that national human rights institutions play in combating racism and racial discrimination, and of the need to strengthen such institutions and provide them with greater resources,	注意到世界会议承认国家人权机构在打击种族主义和种族歧视的活动中所发挥的重要作用，并承认有必要加强这些机构和为这些机构提供更多的资源；
1. Recommends to States:	1. 建议各缔约国采取：
I. Measures to strengthen the implementation	一、加强执行《公约》的措施
of the Convention (a) If they have not yet done so, to accede to the International Convention on the Elimination of All Forms of Racial Discrimination with a view to universal ratification by the year 2005;	尚未加入《消除一切形式种族歧视国际公约》的国家加入该《公约》，以期2005年前获得普遍批准；
(b) If they have not yet done so, to consider making the optional declaration envisaged under article 14 of the Convention;	尚未作出依《公约》第十四条规定的任择声明的国家作出任择声明；
(c) To comply with their reporting obligations under the Convention by presenting reports in a timely manner in conformity with the relevant guidelines;	遵守《公约》规定的报告义务，根据有关准则及时提交报告；
(d) To consider withdrawing their reservations to the Convention;	考虑撤消其对《公约》所作保留；
(e) To make increased efforts to inform the public of the existence of the complaints mechanism under article 14 of the Convention;	加大努力使公众了解可利用《公约》第十四条所规定的控诉机制；
(f) To take into account the relevant parts of the Durban Declaration and Programme of Action when implementing the Convention in the domestic legal order, in particular in respect of articles 2 to 7 of the Convention;	在国内法律制度中执行《公约》时，尤其是在《公约》第二至第七条方面，注意《德班宣言和行动纲领》的相关部分；
(g) To include in their periodic reports information on action plans or other measures they have taken to implement the Durban Declaration and Programme of Action at the national level;	在定期报告中纳入有关本国为执行《德班宣言和行动纲领》所采取的行动计划或其他措施的信息；
(h) To disseminate the Durban Declaration and Programme of Action in an appropriate manner and provide the Committee with information on the efforts in this respect under the section of their periodic reports concerning article 7 of the Convention;	以适当的方式传播《德班宣言和行动纲领》，并在其定期报告中的涉及《公约》第七条的章节中向委员会提供关于这方面工作的信息。
II. Measures to strengthen the functioning of the Committee	二、加强委员会职能的措施
(i) To consider setting up appropriate national monitoring and evaluation mechanisms to ensure that all appropriate steps are taken to follow-up the concluding observations and general recommendations of the Committee;	考虑设立适当的国家监督和评估机制，以确保采取所有适当步骤按委员会的结论性意见和一般性建议开展后续行动；
(j) To include in their periodic reports to the Committee appropriate information on the follow-up to such concluding observations and recommendations;	在提交委员会的定期报告中纳入有关按这些结论性意见和一般性建议开展的后续行动的适当信息；
(k) To ratify the amendment to article 8, paragraph 6, of the Convention adopted on 15 January 1992 at the 14th meeting of States parties to the Convention and endorsed by the General Assembly in its resolution 47/111 of 15 December 1992;	批准《公约》缔约国第十四次会议于1992年1月15日通过的、大会1992年12月15日第47/111号决议所核准的《公约》第八条第六款修正案；
(l) To continue cooperating with the Committee with a view to promoting the effective implementation of the Convention;	继续与委员会进行合作，以促进《公约》的有效执行；

(a) That national human rights institutions assist their respective States to comply with their reporting obligations and closely monitor the follow-up to the concluding observations and recommendations of the Committee;	国家人权机构协助本国遵守报告义务并密切监督为委员会结论性意见和建议所展开的后续行动；
(b) That non-governmental organizations continue to provide the Committee in good time with relevant information in order to enhance its cooperation with them;	非政府组织继续及时地为委员会提供相关信息，以加强其与委员会的合作；
(c) That the Office of the High Commissioner for Human Rights continue its efforts to increase awareness of the work of the Committee;	人权事务高级专员办事处继续努力提高人们对委员会工作的认识；
(d) That the competent United Nations bodies provide the Committee with adequate resources to enable it to discharge its mandate fully;	联合国主管机关为委员会提供足够资源使其能全面履行其职责；

(a) To cooperate fully with all relevant institutions of the United Nations system, in particular the Office of the High Commissioner for Human Rights, in following up the Durban Declaration and Programme of Action;	与联合国系统的所有相关机构，特别是与人权事务高级专员办事处全面合作开展《德班宣言和行动纲领》的后续行动；
(b) To cooperate with the five independent eminent experts to be appointed by the Secretary-General to facilitate the implementation of the recommendations of the Durban Declaration and Programme of Action;	与秘书长拟为促进《德班宣言和行动纲领》各项建议的执行而任命的5位著名独立专家进行合作；
(c) To coordinate its activities with the other human rights treaty bodies with a view to achieving a more effective follow-up of the Durban Declaration and Programme of Action;	与其他人权条约机构协调活动，争取更有效地开展《德班宣言和行动纲领》的后续行动；
(d) To take into consideration all aspects of the Durban Declaration and Programme of Action concerning the fulfilment of its mandate.	考虑《德班宣言和行动纲领》中涉及履行其职责的所有方面。
