Acknowledging that change in the Earth's climate and its adverse effects are a common concern of humankind,承认地球气候的变化及其不利影响是人类共同关心的问题,

ARTICLE 1第一条

For the purposes of this Convention:为本公约的目的:
1.1.
"Adverse effects of climate change" means changes in the physical environment or biota resulting from climate change which have significant deleterious effects on the composition, resilience or productivity of natural and managed ecosystems or on the operation of socio-economic systems or on human health and welfare.“气候变化的不利影响”指气候变化所造成的自然环境或生物区系的变化,这些变化对自然的和管理下的生态系统的组成、复原力或生产力、或对社会经济系统的运作、或对人类的健康和福利产生重大的有害影响。
2.2.
"Climate change” means a change of climate which is attributed directly or indirectly to human activity that alters the composition of the global atmosphere and which is in addition to natural climate variability observed over comparable time periods.“气候变化”指除在类似时期内所观测的气候的自然变异之外,由于直接或间接的人类活动改变了地球大气的组成而造成的气候变化。
3.3.
"Climate system" means the totality of the atmosphere, hydrosphere, biosphere and geosphere and their interactions.“气候系统”指大气圈、水圈、生物圈和地圈的整体及其相互作用。
4.4.
"Emissions" means the release of greenhouse gases and/or their precursors into the atmosphere over a specified area and period of time.“排放”指温室气体和/或其前体在一个特定地区和时期内向大气的释放。
5.5.
"Greenhouse gases" means those gaseous constituents of the atmosphere, both natural and anthropogenic, that absorb and re-emit infrared radiation.“温室气体”指大气中那些吸收和重新放出红外辐射的自然的和人为的气态成分。

"Regional economic integration organization" means an organization constituted by sovereign States of a given region which has competence in respect of matters governed by this Convention or its protocols and has been duly authorized, in accordance with its internal procedures, to sign, ratify, accept, approve or accede to the instruments concerned.“区域经济一体化组织”指一个特定区域的主权国家组成的组织,有权处理本公约或其议定书所规定的事项,并经按其内部程序获得正式授权签署、批准、接受、核准或加入有关文书。
7.7.
"Reservoir" means a component or components of the climate system where a greenhouse gas or a precursor of a greenhouse gas is stored.“库”指气候系统内存储温室气体或其前体的一个或多个组成部分。

"Sink" means any process, activity or mechanism which removes a greenhouse gas, an aerosol or a precursor of a greenhouse gas from the atmosphere.“汇”指从大气中清除温室气体、气溶胶或温室气体前体的任何过程、活动或机制。

ARTICLE 2第二条
OBJECTIVE目标
The ultimate objective of this Convention and any related legal instruments that the Conference of the Parties may adopt is to achieve, in accordance with the relevant provisions of the Convention, stabilization of greenhouse gas concentrations in the atmosphere at a level that would prevent dangerous anthropogenic interference with the climate system.本公约以及缔约方会议可能通过的任何相关法律文书的最终目标是:根据本公约的各项有关规定,将大气中温室气体的浓度稳定在防止气候系统受到危险的人为干扰的水平上。
Such a level should be achieved within a time-frame sufficient to allow ecosystems to adapt naturally to climate change, to ensure that food production is not threatened and to enable economic development to proceed in a sustainable manner.这一水平应当在足以使生态系统能够自然地适应气候变化、确保粮食生产免受威胁并使经济发展能够可持续地进行的时间范围内实现。
ARTICLE 3第三条
PRINCIPLES原则
In their actions to achieve the objective of the Convention and to implement its provisions, the Parties shall be guided, inter alia, by the following:各缔约方在为实现本公约的目标和履行其各项规定而采取行动时,除其他外,应以下列作为指导:

The Parties should protect the climate system for the benefit of present and future generations of humankind, on the basis of equity and in accordance with their common but differentiated responsibilities and respective capabilities.各缔约方应当在公平的基础上,并根据它们共同但有区别的责任和各自的能力,为人类当代和后代的利益保护气候系统。
Accordingly, the developed country Parties should take the lead in combating climate change and the adverse effects thereof.因此,发达国家缔约方应当率先对付气候变化及其不利影响。
2.2.
The specific needs and special circumstances of developing country Parties, especially those that are particularly vulnerable to the adverse effects of climate change, and of those Parties, especially developing country Parties, that would have to bear a disproportionate or abnormal burden under the Convention, should be given full consideration.应当充分考虑到发展中国家缔约方尤其是特别易受气候变化不利影响的那些发展中国家缔约方的具体需要和特殊情况,也应当充分考虑到那些按本公约必须承担不成比例或不正常负担的缔约方特别是发展中国家缔约方的具体需要和特殊情况。
3.3.
The Parties should take precautionary measures to anticipate, prevent or minimize the causes of climate change and mitigate its adverse effects.各缔约方应当采取预防措施,预测、防止或尽量减少引起气候变化的原因,并缓解其不利影响。
Where there are threats of serious or irreversible damage, lack of full scientific certainty should not be used as a reason for postponing such measures, taking into account that policies and measures to deal with climate change should be cost-effective so as to ensure global benefits at the lowest possible cost.当存在造成严重或不可逆转的损害的威胁时,不应当以科学上没有完全的确定性为理由推迟采取这类措施,同时考虑到应付气候变化的政策和措施应当讲求成本效益,确保以尽可能最低的费用获得全球效益。
To achieve this, such policies and measures should take into account different socio-economic contexts, be comprehensive, cover all relevant sources, sinks and reservoirs of greenhouse gases and adaptation, and comprise all economic sectors.为此,这种政策和措施应当考虑到不同的社会经济情况,并且应当具有全面性,包括所有有关的温室气体源、汇和库及适应措施,并涵盖所有经济部门。
Efforts to address climate change may be carried out cooperatively by interested Parties.应付气候变化的努力可由有关的缔约方合作进行。
4.4.
The Parties have a right to, and should, promote sustainable development.各缔约方有权并且应当促进可持续的发展。
Policies and measures to protect the climate system against human-induced change should be appropriate for the specific conditions of each Party and should be integrated with national development programmes, taking into account that economic development is essential for adopting measures to address climate change.保护气候系统免遭人为变化的政策和措施应当适合每个缔约方的具体情况,并应当结合到国家的发展计划中去,同时考虑到经济发展对于采取措施应付气候变化是至关重要的。
5.5.
The Parties should cooperate to promote a supportive and open international economic system that would lead to sustainable economic growth and development in all Parties, particularly developing country Parties, thus enabling them better to address the problems of climate change.各缔约方应当合作促进有利的和开放的国际经济体系,这种体系将促成所有缔约方特别是发展中国家缔约方的可持续经济增长和发展,从而使它们有能力更好地应付气候变化的问题。
Measures taken to combat climate change, including unilateral ones, should not constitute a means of arbitrary or unjustifiable discrimination or a disguised restriction on international trade.为对付气候变化而采取的措施,包括单方面措施,不应当成为国际贸易上的任意或无理的歧视手段或者隐蔽的限制。
ARTICLE 4第四条
COMMITMENTS承诺
1.1.
All Parties, taking into account their common but differentiated responsibilities and their specific national and regional development priorities, objectives and circumstances, shall:所有缔约方,考虑到它们共同但有区别的责任,以及各自具体的国家和区域发展优先顺序、目标和情况,应:
(a) Develop, periodically update, publish and make available to the Conference of the Parties, in accordance with Article 12, national inventories of anthropogenic emissions by sources and removals by sinks of all greenhouse gases not controlled by the Montreal Protocol, using comparable methodologies to be agreed upon by the Conference of the Parties;(a) 用待由缔约方会议议定的可比方法编制、定期更新、公布并按照第十二条向缔约方会议提供关于《蒙特利尔议定书》未予管制的所有温室气体的各种源的人为排放和各种汇的清除的国家清单;
(b) Formulate, implement, publish and regularly update national and, where appropriate, regional programmes containing measures to mitigate climate change by addressing anthropogenic emissions by sources and removals by sinks of all greenhouse gases not controlled by the Montreal Protocol, and measures to facilitate adequate adaptation to climate change; (c)(b) 制订、执行、公布和经常地更新国家的以及在适当情况下区域的计划,其中包含从《蒙特利尔议定书》未予管制的所有温室气体的源的人为排放和汇的清除来着手减缓气候变化的措施,以及便利充分地适应气候变化的措施;
Promote and cooperate in the development, application and diffusion, including transfer, of technologies, practices and processes that control, reduce or prevent anthropogenic emissions of greenhouse gases not controlled by the Montreal Protocol in all relevant sectors, including the energy, transport, industry, agriculture, forestry and waste management sectors;(c) 在所有有关部门,包括能源、运输、工业、农业、林业和废物管理部门,促进和合作发展、应用和传播(包括转让)各种用来控制、减少或防止《蒙特利尔议定书》未予管制的温室气体的人为排放的技术、做法和过程;
(d) Promote sustainable management, and promote and cooperate in the conservation and enhancement, as appropriate, of sinks and reservoirs of all greenhouse gases not controlled by the Montreal Protocol, including biomass, forests and oceans as well as other terrestrial, coastal and marine ecosystems; (e)(d) 促进可持续地管理,并促进和合作酌情维护和加强《蒙特利尔议定书》未予管制的所有温室气体的汇和库、包括生物质、森林和海洋以及其它陆地、沿海和海洋生态系统;
Cooperate in preparing for adaptation to the impacts of climate change; develop and elaborate appropriate and integrated plans for coastal zone management, water resources and agriculture, and for the protection and rehabilitation of areas, particularly in Africa, affected by drought and desertification, as well as floods;(e) 合作为适应气候变化的影响做好准备;拟订和详细制定关于沿海地区的管理、水资源和农业以及关于受到旱灾和沙漠化及洪水影响的地区特别是非洲的这种地区的保护和恢复的适当的综合性计划;
(f) Take climate change considerations into account, to the extent feasible, in their relevant social, economic and environmental policies and actions, and employ appropriate methods, for example impact assessments, formulated and determined nationally, with a view to minimizing adverse effects on the economy, on public health and on the quality of the environment, of projects or measures undertaken by them to mitigate or adapt to climate change; (g)(f) 在它们有关的社会、经济和环境政策及行动中,在可行的范围内将气候变化考虑进去,并采用由本国拟订和确定的适当办法,例如进行影响评估,以期尽量减少它们为了减缓或适应气候变化而进行的项目或采取的措施对经济、公共健康和环境质量产生的不利影响;
Promote and cooperate in scientific, technological, technical, socio-economic and other research, systematic observation and development of data archives related to the climate system and intended to further the understanding and to reduce or eliminate the remaining uncertainties regarding the causes, effects, magnitude and timing of climate change and the economic and social consequences of various response strategies;(g) 促进和合作进行关于气候系统的科学、技术、工艺、社会经济和其他研究、系统观测及开发数据档案,目的是增进对气候变化的起因、影响、规模和发生时间以及各种应对战略所带来的经济和社会后果的认识,和减少或消除在这些方面尚存的不确定性;
(h) Promote and cooperate in the full, open and prompt exchange of relevant scientific, technological, technical, socio-economic and legal information related to the climate system and climate change, and to the economic and social consequences of various response strategies;(h) 促进和合作进行关于气候系统和气候变化以及关于各种应对战略所带来的经济和社会后果的科学、技术、工艺、社会经济和法律方面的有关信息的充分、公开和迅速的交流;
(i) Promote and cooperate in education, training and public awareness related to climate change and encourage the widest participation in this process, including that of non-governmental organizations; and (j)(i) 促进和合作进行与气候变化有关的教育、培训和提高公众意识的工作,并鼓励人们对这个过程最广泛参与,包括鼓励各种非政府组织的参与;
Communicate to the Conference of the Parties information related to implementation, in accordance with Article 12.(j) 依照第十二条向缔约方会议提供有关履行的信息。
2.2.
The developed country Parties and other Parties included in Annex I commit themselves specifically as provided for in the following:附件一所列的发达国家缔约方和其他缔约方具体承诺如下所规定:
(a) Each of these Parties shall adopt national policies and take corresponding measures on the mitigation of climate change, by limiting its anthropogenic emissions of greenhouse gases and protecting and enhancing its greenhouse gas sinks and reservoirs.(a) 每一个此类缔约方应制定国家政策和采取相应的措施,通过限制其人为的温室气体排放以及保护和增强其温室气体库和汇,减缓气候变化。
These policies and measures will demonstrate that developed countries are taking the lead in modifying longer-term trends in anthropogenic emissions consistent with the objective of the Convention, recognizing that the return by the end of the present decade to earlier levels of anthropogenic emissions of carbon dioxide and other greenhouse gases not controlled by the Montreal Protocol would contribute to such modification, and taking into account the differences in these Parties' starting points and approaches, economic structures and resource bases, the need to maintain strong and sustainable economic growth, available technologies and other individual circumstances, as well as the need for equitable and appropriate contributions by each of these Parties to the global effort regarding that objective.这 些政策和措施将表明,发达国家是在带头依循本公约的目标,改变人为排放的长期趋势,同时认识到至本十年末使二氧化碳和《蒙特利尔议定书》未予管制的其他温 室气体的人为排放回复到较早的水平,将会有助于这种改变,并考虑到这些缔约方的起点和做法、经济结构和资源基础方面的差别、维持强有力和可持续经济增长的 需要、可以采用的技术以及其他个别情况,又考虑到每一个此类缔约方都有必要对为了实现该目标而作的全球努力作出公平和适当的贡献。
These Parties may implement such policies and measures jointly with other Parties and may assist other Parties in contributing to the achievement of the objective of the Convention and, in particular, that of this subparagraph;这些缔约方可以同其他缔约方共同执行这些政策和措施,也可以协助其他缔约方为实现本公约的目标特别是本项的目标作出贡献;
(b) In order to promote progress to this end, each of these Parties shall communicate, within six months of the entry into force of the Convention for it and periodically thereafter, and in accordance with Article 12, detailed information on its policies and measures referred to in subparagraph (a) above, as well as on its resulting projected anthropogenic emissions by sources and removals by sinks of greenhouse gases not controlled by the Montreal Protocol for the period referred to in subparagraph (a), with the aim of returning individually or jointly to their 1990 levels these anthropogenic emissions of carbon dioxide and other greenhouse gases not controlled by the Montreal Protocol.(b) 为了推动朝这一目标取得进展,每一个此类缔约方应依照第十二条,在本公约对其生效后六个月内,并在其后定期地就其上述(a)项所述的政策和措施,以及就其 由此预测在(a)项所述期间内《蒙特利尔议定书》未予管制的温室气体的源的人为排放和汇的清除,提供详细信息,目的在个别地或共同地使二氧化碳和《蒙特利 尔议定书》未予管制的其他温室气体的人为排放回复到1990年的水平。
This information will be reviewed by the Conference of the Parties, at its first session and periodically thereafter, in accordance with Article 7;按照第七条,这些信息将由缔约方会议在其第一届会议上以及在其后定期地加以审评;

The Conference of the Parties shall consider and agree on methodologies for these calculations at its first session and review them regularly thereafter;缔约方会议应在其第一届会议上考虑和议定进行这些计算的方法,并在其后经常地加以审评;

Based on this review, the Conference of the Parties shall take appropriate action, which may include the adoption of amendments to the commitments in subparagraphs (a) and (b) above.在审评的基础上,缔约方会议应采取适当的行动,其中可以包括通过对上述(a)项和(b)项承诺的修正。
The Conference of the Parties, at its first session, shall also take decisions regarding criteria for joint implementation as indicated in subparagraph (a) above.缔约方会议第一届会议还应就上述(a)项所述共同执行的标准作出决定。
A second review of subparagraphs (a) and (b) shall take place not later than 31 December 1998, and thereafter at regular intervals determined by the Conference of the Parties, until the objective of the Convention is met;对(a)项和(b)项的第二次审评应不迟于1998年12月31日进行,其后按由缔约方会议确定的定期间隔进行,直至本公约的目标达到为止;
(e) Each of these Parties shall: (i)(e) 每一个此类缔约方应:

(f) The Conference of the Parties shall review, not later than 31 December 1998, available information with a view to taking decisions regarding such amendments to the lists in Annexes I and II as may be appropriate, with the approval of the Party concerned;(f) 缔约方会议应至迟在1998年12月31日之前审评可以得到的信息,以便经有关缔约方同意,作出适当修正附件一和二内名单的决定。

The developed country Parties and other developed Parties included in Annex II shall provide new and additional financial resources to meet the agreed full costs incurred by developing country Parties in complying with their obligations under Article 12, paragraph 1.附件二所列的发达国家缔约方和其他发达缔约方应提供新的和额外的资金,以支付经议定的发展中国家缔约方为履行第十二条第1款规定的义务而招致的全部费用。
They shall also provide such financial resources, including for the transfer of technology, needed by the developing country Parties to meet the agreed full incremental costs of implementing measures that are covered by paragraph 1 of this Article and that are agreed between a developing country Party and the international entity or entities referred to in Article 11, in accordance with that Article.它们还应提供发展中国家缔约方所需要的资金,包括用于技术转让的资金,以支付经议定的为执行本条第1款所述并经发展中国家缔约方同第十一条所述那个或那些国际实体依该条议定的措施的全部增加费用。

4.4.
The developed country Parties and other developed Parties included in Annex II shall also assist the developing country Parties that are particularly vulnerable to the adverse effects of climate change in meeting costs of adaptation to those adverse effects.附件二所列的发达国家缔约方和其他发达缔约方还应帮助特别易受气候变化不利影响的发展中国家缔约方支付适应这些不利影响的费用。
5.5.
The developed country Parties and other developed Parties included in Annex II shall take all practicable steps to promote, facilitate and finance, as appropriate, the transfer of, or access to, environmentally sound technologies and know-how to other Parties, particularly developing country Parties, to enable them to implement the provisions of the Convention.附件二所列的发达国家缔约方和其他发达缔约方应采取一切实际可行的步骤,酌情促进、便利和资助向其他缔约方特别是发展中国家缔约方转让或使它们有机会得到无害环境的技术和专有技术,以使它们能够履行本公约的各项规定。

Other Parties and organizations in a position to do so may also assist in facilitating the transfer of such technologies.有能力这样做的其他缔约方和组织也可协助便利这类技术的转让。
6.6.
In the implementation of their commitments under paragraph 2 above, a certain degree of flexibility shall be allowed by the Conference of the Parties to the Parties included in Annex I undergoing the process of transition to a market economy, in order to enhance the ability of these Parties to address climate change, including with regard to the historical level of anthropogenic emissions of greenhouse gases not controlled by the Montreal Protocol chosen as a reference.对于附件一所列正在朝市场经济过渡的缔约方,在履行其在上述第2款下的承诺时,包括在《蒙特利尔议定书》未予管制的温室气体人为排放的可资参照的历史水平方面,应由缔约方会议允许它们有一定程度的灵活性,以增强这些缔约方应付气候变化的能力。
7.7.
The extent to which developing country Parties will effectively implement their commitments under the Convention will depend on the effective implementation by developed country Parties of their commitments under the Convention related to financial resources and transfer of technology and will take fully into account that economic and social development and poverty eradication are the first and overriding priorities of the developing country Parties.发展中国家缔约方能在多大程度上有效履行其在本公约下的承诺,将取决于发达国家缔约方对其在本公约下所承担的有关资金和技术转让的承诺的有效履行,并将充分考虑到经济和社会发展及消除贫困是发展中国家缔约方的首要和压倒一切的优先事项。
8.8.
In the implementation of the commitments in this Article, the Parties shall give full consideration to what actions are necessary under the Convention, including actions related to funding, insurance and the transfer of technology, to meet the specific needs and concerns of developing country Parties arising from the adverse effects of climate change and/or the impact of the implementation of response measures, especially on:在履行本条各项承诺时,各缔约方应充分考虑按照本公约需要采取哪些行动,包括与提供资金、保险和技术转让有关的行动,以满足发展中国家缔约方由于气候变化的不利影响和/或执行应对措施所造成的影响,特别是对下列各类国家的影响,而产生的具体需要和关注:

Further, the Conference of the Parties may take actions, as appropriate, with respect to this paragraph.此外,缔约方会议可酌情就本款采取行动。
9.9.
The Parties shall take full account of the specific needs and special situations of the least developed countries in their actions with regard to funding and transfer of technology.各缔约方在采取有关提供资金和技术转让的行动时,应充分考虑到最不发达国家的具体需要和特殊情况。
10.10.
The Parties shall, in accordance with Article 10, take into consideration in the implementation of the commitments of the Convention the situation of Parties, particularly developing country Parties, with economies that are vulnerable to the adverse effects of the implementation of measures to respond to climate change.各缔约方应按照第十条,在履行本公约各项承诺时,考虑到其经济容易受到执行应付气候变化的措施所造成的不利影响之害的缔约方、特别是发展中国家缔约方的情况。
This applies notably to Parties with economies that are highly dependent on income generated from the production, processing and export, and/or consumption of fossil fuels and associated energy-intensive products and/or the use of fossil fuels for which such Parties have serious difficulties in switching to alternatives.这尤其适用于其经济高度依赖于矿物燃料和相关的能源密集产品的生产、加工和出口所带来的收入,和/或高度依赖于这种燃料和产品的消费,和/或高度依赖于矿物燃料的使用,而改用其他燃料又非常困难的那些缔约方。
ARTICLE 5第五条
RESEARCH AND SYSTEMATIC OBSERVATION研究和系统观测
In carrying out their commitments under Article 4, paragraph 1(g), the Parties shall:在履行第四条第1款(g)项下的承诺时,各缔约方应:
(a) Support and further develop, as appropriate, international and intergovernmental programmes and networks or organizations aimed at defining, conducting, assessing and financing research, data collection and systematic observation, taking into account the need to minimize duplication of effort;(a) 支持并酌情进一步制订旨在确定、进行、评估和资助研究、数据收集和系统观测的国际和政府间计划和站网或组织,同时考虑到有必要尽量减少工作重复;
(b) Support international and intergovernmental efforts to strengthen systematic observation and national scientific and technical research capacities and capabilities, particularly in developing countries, and to promote access to, and the exchange of, data and analyses thereof obtained from areas beyond national jurisdiction; and(b) 支持旨在加强尤其是发展中国家的系统观测及国家科学和技术研究能力的国际和政府间努力,并促进获取和交换从国家管辖范围以外地区取得的数据及其分析;和
(c) Take into account the particular concerns and needs of developing countries and cooperate in improving their endogenous capacities and capabilities to participate in the efforts referred to in subparagraphs (a) and (b) above.(c) 考虑发展中国家的特殊关注和需要,并开展合作提高它们参与上述(a)项和(b)项中所述努力的自生能力。
ARTICLE 6第六条
EDUCATION, TRAINING AND PUBLIC AWARENESS教育、培训和公众意识
In carrying out their commitments under Article 4, paragraph 1(i), the Parties shall:在履行第四条第1款(i)项下的承诺时,各缔约方应:
(a) Promote and facilitate at the national and, as appropriate, subregional and regional levels, and in accordance with national laws and regulations, and within their respective capacities:(a) 在国家一级并酌情在次区域和区域一级,根据国家法律和规定,并在各自的能力范围内,促进和便利;
(i) The development and implementation of educational and public awareness programmes on climate change and its effects;(一) 拟订和实施有关气候变化及其影响的教育及提高公众意识的计划;

(i) The development and exchange of educational and public awareness material on climate change and its effects; and(一) 编写和交换有关气候变化及其影响的教育及提高公众意识的材料;和

ARTICLE 7第七条
CONFERENCE OF THE PARTIES缔约方会议
1.1.
A Conference of the Parties is hereby established.兹设立缔约方会议。
2.2.
The Conference of the Parties, as the supreme body of this Convention, shall keep under regular review the implementation of the Convention and any related legal instruments that the Conference of the Parties may adopt, and shall make, within its mandate, the decisions necessary to promote the effective implementation of the Convention.缔约方会议作为本公约的最高机构,应定期审评本公约和缔约方会议可能通过的任何相关法律文书的履行情况,并应在其职权范围内作出为促进本公约的有效履行所必要的决定。
To this end, it shall:为此目的,缔约方会议应:
(a) Periodically examine the obligations of the Parties and the institutional arrangements under the Convention, in the light of the objective of the Convention, the experience gained in its implementation and the evolution of scientific and technological knowledge;(a) 根据本公约的目标,在履行本公约过程中取得的经验和科学与技术知识的发展,定期审评本公约规定的缔约方义务和机构安排;
(b) Promote and facilitate the exchange of information on measures adopted by the Parties to address climate change and its effects, taking into account the differing circumstances, responsibilities and capabilities of the Parties and their respective commitments under the Convention;(b) 促进和便利就各缔约方为应付气候变化及其影响而采取的措施进行信息交流,同时考虑到各缔约方不同的情况、责任和能力以及各自在本公约下的承诺;
(c) Facilitate, at the request of two or more Parties, the coordination of measures adopted by them to address climate change and its effects, taking into account the differing circumstances, responsibilities and capabilities of the Parties and their respective commitments under the Convention;(c) 应两个或更多的缔约方的要求,便利将这些缔约方为应付气候变化及其影响而采取的措施加以协调,同时考虑到各缔约方不同的情况、责任和能力以及各自在本公约下的承诺;
(d) Promote and guide, in accordance with the objective and provisions of the Convention, the development and periodic refinement of comparable methodologies, to be agreed on by the Conference of the Parties, inter alia, for preparing inventories of greenhouse gas emissions by sources and removals by sinks, and for evaluating the effectiveness of measures to limit the emissions and enhance the removals of these gases;(d) 依照本公约的目标和规定,促进和指导发展和定期改进由缔约方会议议定的,除其他外,用来编制各种温室气体源的排放和各种汇的清除的清单,和评估为限制这些气体的排放及增进其清除而采取的各种措施的有效性的可比方法;

(h) Seek to mobilize financial resources in accordance with Article 4, paragraphs 3, 4 and 5, and Article 11;(h) 按照第四条第3、第4和第5款及第十一条,设法动员资金;
(i) Establish such subsidiary bodies as are deemed necessary for the implementation of the Convention;(i) 设立其认为履行公约所必需的附属机构;
(j) Review reports submitted by its subsidiary bodies and provide guidance to them;(j) 审评其附属机构提出的报告,并向它们提供指导;
(k) Agree upon and adopt, by consensus, rules of procedure and financial rules for itself and for any subsidiary bodies;(k) 以协商一致方式议定并通过缔约方会议和任何附属机构的议事规则和财务规则;
(l) Seek and utilize, where appropriate, the services and cooperation of, and information provided by, competent international organizations and intergovernmental and non-governmental bodies; and(l) 酌情寻求和利用各主管国际组织和政府间及非政府机构提供的服务、合作和信息;和
(m) Exercise such other functions as are required for the achievement of the objective of the Convention as well as all other functions assigned to it under the Convention.(m) 行使实现本公约目标所需的其他职能以及依本公约所赋予的所有其他职能。
3.3.
The Conference of the Parties shall, at its first session, adopt its own rules of procedure as well as those of the subsidiary bodies established by the Convention, which shall include decision-making procedures for matters not already covered by decision-making procedures stipulated in the Convention.缔约方会议应在其第一届会议上通过其本身的议事规则以及本公约所设立的附属机构的议事规则,其中应包括关于本公约所述各种决策程序未予规定的事项的决策程序。
Such procedures may include specified majorities required for the adoption of particular decisions.这类程序可包括通过具体决定所需的特定多数。
4.4.
The first session of the Conference of the Parties shall be convened by the interim secretariat referred to in Article 21 and shall take place not later than one year after the date of entry into force of the Convention.缔约方会议第一届会议应由第二十一条所述的临时秘书处召集,并应不迟于本公约生效日期后一年举行。
Thereafter, ordinary sessions of the Conference of the Parties shall be held every year unless otherwise decided by the Conference of the Parties.其后,除缔约方会议另有决定外,缔约方会议的常会应年年举行。
5.5.
Extraordinary sessions of the Conference of the Parties shall be held at such other times as may be deemed necessary by the Conference, or at the written request of any Party, provided that, within six months of the request being communicated to the Parties by the secretariat, it is supported by at least one third of the Parties.缔约方会议特别会议应在缔约方会议认为必要的其他时间举行,或应任何缔约方的书面要求而举行,但须在秘书处将该要求转达给各缔约方后六个月内得到至少三分之一缔约方的支持。
6.6.
The United Nations, its specialized agencies and the International Atomic Energy Agency, as well as any State member thereof or observers thereto not Party to the Convention, may be represented at sessions of the Conference of the Parties as observers.联合国及其专门机构和国际原子能机构,以及它们的非为本公约缔约方的会员国或观察员,均可作为观察员出席缔约方会议的各届会议。
Any body or agency, whether national or international, governmental or non-governmental, which is qualified in matters covered by the Convention, and which has informed the secretariat of its wish to be represented at a session of the Conference of the Parties as an observer, may be so admitted unless at least one third of the Parties present object.任何在本公约所涉事项上具备资格的团体或机构,不管其为国家或国际的、政府或非政府的,经通知秘书处其愿意作为观察员出席缔约方会议的某届会议,均可予以接纳,除非出席的缔约方至少三分之一反对。
The admission and participation of observers shall be subject to the rules of procedure adopted by the Conference of the Parties.观察员的接纳和参加应遵循缔约方会议通过的议事规则。
ARTICLE 8第八条
SECRETARIAT秘书处
1.1.
A secretariat is hereby established.兹设立秘书处。
2.2.
The functions of the secretariat shall be:秘书处的职能应为:
(a) To make arrangements for sessions of the Conference of the Parties and its subsidiary bodies established under the Convention and to provide them with services as required;(a) 安排缔约方会议及依本公约设立的附属机构的各届会议,并向它们提供所需的服务;
(b) To compile and transmit reports submitted to it;(b) 汇编和转递向其提交的报告;
(c) To facilitate assistance to the Parties, particularly developing country Parties, on request, in the compilation and communication of information required in accordance with the provisions of the Convention;(c) 便利应要求时协助各缔约方特别是发展中国家缔约方汇编和转递依本公约规定所需的信息;
(d) To prepare reports on its activities and present them to the Conference of the Parties;(d) 编制关于其活动的报告,并提交给缔约方会议;

The Conference of the Parties, at its first session, shall designate a permanent secretariat and make arrangements for its functioning.缔约方会议应在其第一届会议上指定一个常设秘书处,并为其行使职能作出安排。
ARTICLE 9第九条
SUBSIDIARY BODY FOR SCIENTIFIC AND TECHNOLOGICAL ADVICE附属科技咨询机构
1.1.
A subsidiary body for scientific and technological advice is hereby established to provide the Conference of the Parties and, as appropriate, its other subsidiary bodies with timely information and advice on scientific and technological matters relating to the Convention.兹设立附属科学和技术咨询机构,就与公约有关的科学和技术事项,向缔约方会议并酌情向缔约方会议的其他附属机构及时提供信息和咨询。
This body shall be open to participation by all Parties and shall be multidisciplinary.该机构应开放供所有缔约方参加,并应具有多学科性。
It shall comprise government representatives competent in the relevant field of expertise.该机构应由在有关专门领域胜任的政府代表组成。
It shall report regularly to the Conference of the Parties on all aspects of its work.该机构应定期就其工作的一切方面向缔约方会议报告。

Under the guidance of the Conference of the Parties, and drawing upon existing competent international bodies, this body shall:在缔约方会议指导下和依靠现有主管国际机构,该机构应:

(d) Provide advice on scientific programmes, international cooperation in research and development related to climate change, as well as on ways and means of supporting endogenous capacity-building in developing countries; and(d) 就有关气候变化的科学计划和研究与发展的国际合作,以及就支持发展中国家建立自生能力的途径与方法提供咨询;和

3.3.
The functions and terms of reference of this body may be further elaborated by the Conference of the Parties.该机构的职能和职权范围可由缔约方会议进一步制定。
ARTICLE 10第十条
SUBSIDIARY BODY FOR IMPLEMENTATION附属履行机构

A subsidiary body for implementation is hereby established to assist the Conference of the Parties in the assessment and review of the effective implementation of the Convention.兹设立附属履行机构,以协助缔约方会议评估和审评本公约的有效履行。
This body shall be open to participation by all Parties and comprise government representatives who are experts on matters related to climate change.该机构应开放供所有缔约方参加,并由为气候变化问题专家的政府代表组成。
It shall report regularly to the Conference of the Parties on all aspects of its work.该机构应定期就其工作的一切方面向缔约方会议报告。
2.2.
Under the guidance of the Conference of the Parties, this body shall:在缔约方会议的指导下,该机构应:
(a) Consider the information communicated in accordance with Article 12, paragraph 1, to assess the overall aggregated effect of the steps taken by the Parties in the light of the latest scientific assessments concerning climate change;(a) 考虑依第十二条第1款提供的信息,参照有关气候变化的最新科学评估,对各缔约方所采取步骤的总体合计影响作出评估;

FINANCIAL MECHANISM资金机制
1.1.
A mechanism for the provision of financial resources on a grant or concessional basis, including for the transfer of technology, is hereby defined.兹确定一个在赠予或转让基础上提供资金、包括用于技术转让的资金的机制。
It shall function under the guidance of and be accountable to the Conference of the Parties, which shall decide on its policies, programme priorities and eligibility criteria related to this Convention.该机制应在缔约方会议的指导下行使职能并向其负责,并应由缔约方会议决定该机制与本公约有关的政策、计划优先顺序和资格标准。
Its operation shall be entrusted to one or more existing international entities.该机制的经营应委托一个或多个现有的国际实体负责。
2.2.
The financial mechanism shall have an equitable and balanced representation of all Parties within a transparent system of governance.该资金机制应在一个透明的管理制度下公平和均衡地代表所有缔约方。
3.3.
The Conference of the Parties and the entity or entities entrusted with the operation of the financial mechanism shall agree upon arrangements to give effect to the above paragraphs, which shall include the following:缔约方会议和受托管资金机制的那个或那些实体应议定实施上述各款的安排,其中应包括:
(a) Modalities to ensure that the funded projects to address climate change are in conformity with the policies, programme priorities and eligibility criteria established by the Conference of the Parties;(a) 确保所资助的应付气候变化的项目符合缔约方会议所制定的政策、计划优先顺序和资格标准的办法;
(b) Modalities by which a particular funding decision may be reconsidered in light of these policies, programme priorities and eligibility criteria;(b) 根据这些政策、计划优先顺序和资格标准重新考虑某项供资决定的办法;
(c) Provision by the entity or entities of regular reports to the Conference of the Parties on its funding operations, which is consistent with the requirement for accountability set out in paragraph 1 above; and(c) 依循上述第1款所述的负责要求,由那个或那些实体定期向缔约方会议提供关于其供资业务的报告;
(d) Determination in a predictable and identifiable manner of the amount of funding necessary and available for the implementation of this Convention and the conditions under which that amount shall be periodically reviewed.(d) 以可预测和可认定的方式确定履行本公约所必需的和可以得到的资金数额,以及定期审评此一数额所应依据的条件。
4.4.
The Conference of the Parties shall make arrangements to implement the above-mentioned provisions at its first session, reviewing and taking into account the interim arrangements referred to in Article 21, paragraph 3, and shall decide whether these interim arrangements shall be maintained.缔约方会议应在其第一届会议上作出履行上述规定的安排,同时审评并考虑到第二十一条第3款所述的临时安排,并应决定这些临时安排是否应予维持。
Within four years thereafter, the Conference of the Parties shall review the financial mechanism and take appropriate measures.在其后四年内,缔约方会议应对资金机制进行审评,并采取适当的措施。
5.5.
The developed country Parties may also provide and developing country Parties avail themselves of, financial resources related to the implementation of the Convention through bilateral, regional and other multilateral channels.发达国家缔约方还可通过双边、区域性和其他多边渠道提供并由发展中国家缔约方获取与履行本公约有关的资金。
ARTICLE 12第十二条
COMMUNICATION OF INFORMATION RELATED TO IMPLEMENTATION提供有关履行的信息
1.1.
In accordance with Article 4, paragraph 1, each Party shall communicate to the Conference of the Parties, through the secretariat, the following elements of information:按照第四条第1款,每一缔约方应通过秘书处向缔约方会议提供含有下列内容的信息:
(a) A national inventory of anthropogenic emissions by sources and removals by sinks of all greenhouse gases not controlled by the Montreal Protocol, to the extent its capacities permit, using comparable methodologies to be promoted and agreed upon by the Conference of the Parties;(a) 在其能力允许的范围内,用缔约方会议所将推行和议定的可比方法编成的关于《蒙特利尔议定书》未予管制的所有温室气体的各种源的人为排放和各种汇的清除的国家清单;
(b) A general description of steps taken or envisaged by the Party to implement the Convention; and(b) 关于该缔约方为履行公约而采取或设想的步骤的一般性描述;和
(c) Any other information that the Party considers relevant to the achievement of the objective of the Convention and suitable for inclusion in its communication, including, if feasible, material relevant for calculations of global emission trends.(c) 该缔约方认为与实现本公约的目标有关并且适合列入其所提供信息的任何其他信息,在可行情况下,包括与计算全球排放趋势有关的资料。
2.2.
Each developed country Party and each other Party included in Annex I shall incorporate in its communication the following elements of information:附件一所列每一发达国家缔约方和每一其他缔约方应在其所提供的信息中列入下列各类信息:
(a) A detailed description of the policies and measures that it has adopted to implement its commitment under Article 4, paragraphs 2(a) and 2(b); and(a) 关于该缔约方为履行其第四条第2款(a)项和(b)项下承诺所采取政策和措施的详细描述;和
(b) A specific estimate of the effects that the policies and measures referred to in subparagraph (a) immediately above will have on anthropogenic emissions by its sources and removals by its sinks of greenhouse gases during the period referred to in Article 4, paragraph 2(a).(b) 关于本款(a)项所述政策和措施在第四条第2款(a)项所述期间对温室气体各种源的排放和各种汇的清除所产生影响的具体估计。
3.3.
In addition, each developed country Party and each other developed Party included in Annex II shall incorporate details of measures taken in accordance with Article 4, paragraphs 3, 4 and 5.此外,附件二所列每一发达国家缔约方和每一其他发达缔约方应列入按照第四条第3、第4和第5款所采取措施的详情。
4.4.
Developing country Parties may, on a voluntary basis, propose projects for financing, including specific technologies, materials, equipment, techniques or practices that would be needed to implement such projects, along with, if possible, an estimate of all incremental costs, of the reductions of emissions and increments of removals of greenhouse gases, as well as an estimate of the consequent benefits.发展中国家缔约方可在自愿基础上提出需要资助的项目,包括为执行这些项目所需要的具体技术、材料、设备、工艺或做法,在可能情况下并附上对所有增加的费用、温室气体排放的减少量及其清除的增加量的估计,以及对其所带来效益的估计。
5.5.
Each developed country Party and each other Party included in Annex I shall make its initial communication within six months of the entry into force of the Convention for that Party.附件一所列每一发达国家缔约方和每一其他缔约方应在公约对该缔约方生效后六个月内第一次提供信息。
Each Party not so listed shall make its initial communication within three years of the entry into force of the Convention for that Party, or of the availability of financial resources in accordance with Article 4, paragraph 3.未列入该附件的每一缔约方应在公约对该缔约方生效后或按照第四条第3款获得资金后三年内第一次提供信息。
Parties that are least developed countries may make their initial communication at their discretion.最不发达国家缔约方可自行决定何时第一次提供信息。
The frequency of subsequent communications by all Parties shall be determined by the Conference of the Parties, taking into account the differentiated timetable set by this paragraph.其后所有缔约方提供信息的频度应由缔约方会议考虑到本款所规定的差别时间表予以确定。
6.6.
Information communicated by Parties under this Article shall be transmitted by the secretariat as soon as possible to the Conference of the Parties and to any subsidiary bodies concerned.各缔约方按照本条提供的信息应由秘书处尽速转交给缔约方会议和任何有关的附属机构。
If necessary, the procedures for the communication of information may be further considered by the Conference of the Parties.如有必要,提供信息的程序可由缔约方会议进一步考虑。
7.7.
From its first session, the Conference of the Parties shall arrange for the provision to developing country Parties of technical and financial support, on request, in compiling and communicating information under this Article, as well as in identifying the technical and financial needs associated with proposed projects and response measures under Article 4.缔约方会议从第一届会议起,应安排向有此要求的发展中国家缔约方提供技术和资金支持,以汇编和提供本条所规定的信息,和确定与第四条规定的所拟议的项目和应对措施相联系的技术和资金需要。
Such support may be provided by other Parties, by competent international organizations and by the secretariat, as appropriate.这些支持可酌情由其他缔约方、主管国际组织和秘书处提供。
8.8.
Any group of Parties may, subject to guidelines adopted by the Conference of the Parties, and to prior notification to the Conference of the Parties, make a joint communication in fulfilment of their obligations under this Article, provided that such a communication includes information on the fulfilment by each of these Parties of its individual obligations under the Convention.任何一组缔约方遵照缔约方会议制定的指导方针并经事先通知缔约方会议,可以联合提供信息来履行其在本条下的义务,但这样提供的信息须包括关于其中每一缔约方履行其在本公约下的各自义务的信息。
9.9.
Information received by the secretariat that is designated by a Party as confidential, in accordance with criteria to be established by the Conference of the Parties, shall be aggregated by the secretariat to protect its confidentiality before being made available to any of the bodies involved in the communication and review of information.秘书处收到的经缔约方按照缔约方会议制订的标准指明为机密的信息,在提供给任何参与信息的提供和审评的机构之前,应由秘书处加以汇总,以保护其机密性。
10.10.
Subject to paragraph 9 above, and without prejudice to the ability of any Party to make public its communication at any time, the secretariat shall make communications by Parties under this Article publicly available at the time they are submitted to the Conference of the Parties.在不违反上述第9款,并且不妨碍任何缔约方在任何时候公开其所提供信息的能力的情况下,秘书处应将缔约方按照本条提供的信息在其提交给缔约方会议的同时予以公开。
ARTICLE 13第十三条
RESOLUTION OF QUESTIONS REGARDING IMPLEMENTATION解决与履行有关的问题
The Conference of the Parties shall, at its first session, consider the establishment of a multilateral consultative process, available to Parties on their request, for the resolution of questions regarding the implementation of the Convention.缔约方会议应在其第一届会议上考虑设立一个解决与公约履行有关的问题的多边协商程序,供缔约方有此要求时予以利用。
ARTICLE 14第十四条
SETTLEMENT OF DISPUTES争端的解决
1.1.
In the event of a dispute between any two or more Parties concerning the interpretation or application of the Convention, the Parties concerned shall seek a settlement of the dispute through negotiation or any other peaceful means of their own choice.任何两个或两个以上缔约方之间就本公约的解释或适用发生争端时,有关的缔约方应寻求通过谈判或它们自己选择的任何其他和平方式解决该争端。
2.2.
When ratifying, accepting, approving or acceding to the Convention, or at any time thereafter, a Party which is not a regional economic integration organization may declare in a written instrument submitted to the Depositary that, in respect of any dispute concerning the interpretation or application of the Convention, it recognizes as compulsory ipso facto and without special agreement, in relation to any Party accepting the same obligation:非为区域经济一体化组织的缔约方在批准、接受、核准或加入本公约时,或在其后任何时候,可在交给保存人的一份文书中声明,关于本公约的解释或适用方面的任何争端,承认对于接受同样义务的任何缔约方,下列义务为当然而具有强制性的,无须另订特别协议:
(a) Submission of the dispute to the International Court of Justice, and/or(a) 将争端提交国际法院,和/或
(b) Arbitration in accordance with procedures to be adopted by the Conference of the Parties as soon as practicable, in an annex on arbitration.(b) 按照将由缔约方会议尽早通过的、载于仲裁附件中的程序进行仲裁。
A Party which is a regional economic integration organization may make a declaration with like effect in relation to arbitration in accordance with the procedures referred to in subparagraph (b) above.作为区域经济一体化组织的缔约方可就依上述(b)项中所述程序进行仲裁发表类似声明。
3.3.
A declaration made under paragraph 2 above shall remain in force until it expires in accordance with its terms or until three months after written notice of its revocation has been deposited with the Depositary.根据上述第2款所作的声明,在其所载有效期期满前,或在书面撤回通知交存于保存人后的三个月内,应一直有效。
4.4.
A new declaration, a notice of revocation or the expiry of a declaration shall not in any way affect proceedings pending before the International Court of Justice or the arbitral tribunal, unless the parties to the dispute otherwise agree.除非争端各当事方另有协议,新作声明、作出撤回通知或声明有效期满丝毫不得影响国际法院或仲裁庭正在进行的审理。
5.5.
Subject to the operation of paragraph 2 above, if after twelve months following notification by one Party to another that a dispute exists between them, the Parties concerned have not been able to settle their dispute through the means mentioned in paragraph 1 above, the dispute shall be submitted, at the request of any of the parties to the dispute, to conciliation.在不影响上述第2款运作的情况下,如果一缔约方通知另一缔约方它们之间存在争端,过了十二个月后,有关的缔约方尚未能通过上述第1款所述方法解决争端,经争端的任何当事方要求,应将争端提交调解。
6.6.
A conciliation commission shall be created upon the request of one of the parties to the dispute.经争端一当事方要求,应设立调解委员会。
The commission shall be composed of an equal number of members appointed by each party concerned and a chairman chosen jointly by the members appointed by each party.调解委员会应由每一当事方委派的数目相同的成员组成, 主席由每一当事方委派的成员共同推选。
The commission shall render a recommendatory award, which the parties shall consider in good faith.调解委员会应作出建议性裁决。 各当事方应善意考虑之。
7.7.
Additional procedures relating to conciliation shall be adopted by the Conference of the Parties, as soon as practicable, in an annex on conciliation.有关调解的补充程序应由缔约方会议尽早以调解附件的形式予以通过。
8.8.
The provisions of this Article shall apply to any related legal instrument which the Conference of the Parties may adopt, unless the instrument provides otherwise.本条各项规定应适用于缔约方会议可能通过的任何相关法律文书,除非该文书另有规定。
ARTICLE 15第十五条
AMENDMENTS TO THE CONVENTION公约的修正
1.1.
Any Party may propose amendments to the Convention.任何缔约方均可对本公约提出修正。
2.2.
Amendments to the Convention shall be adopted at an ordinary session of the Conference of the Parties.对本公约的修正应在缔约方会议的一届常会上通过。
The text of any proposed amendment to the Convention shall be communicated to the Parties by the secretariat at least six months before the meeting at which it is proposed for adoption.对本公约提出的任何修正案文应由秘书处在拟议通过该修正的会议之前至少六个月送交各缔约方。
The secretariat shall also communicate proposed amendments to the signatories to the Convention and, for information, to the Depositary.秘书处还应将提出的修正送交本公约各签署方,并送交保存人以供参考。
3.3.
The Parties shall make every effort to reach agreement on any proposed amendment to the Convention by consensus.各缔约方应尽一切努力以协商一致方式就对本公约提出的任何修正达成协议。
If all efforts at consensus have been exhausted, and no agreement reached, the amendment shall as a last resort be adopted by a three-fourths majority vote of the Parties present and voting at the meeting.如为谋求协商一致已尽了一切努力,仍未达成协议,作为最后的方式,该修正应以出席会议并参加表决的缔约方四分之三多数票通过。
The adopted amendment shall be communicated by the secretariat to the Depositary, who shall circulate it to all Parties for their acceptance.通过的修正应由秘书处送交保存人,再由保存人转送所有缔约方供其接受。
4.4.
Instruments of acceptance in respect of an amendment shall be deposited with the Depositary.对修正的接受文书应交存于保存人。
An amendment adopted in accordance with paragraph 3 above shall enter into force for those Parties having accepted it on the ninetieth day after the date of receipt by the Depositary of an instrument of acceptance by at least three fourths of the Parties to the Convention.按照上述第3款通过的修正,应于保存人收到本公约至少四分之三缔约方的接受文书之日后第九十天起对接受该修正的缔约方生效。
5.5.
The amendment shall enter into force for any other Party on the ninetieth day after the date on which that Party deposits with the Depositary its instrument of acceptance of the said amendment.对于任何其他缔约方,修正应在该缔约方向保存人交存接受该修正的文书之日后第九十天起对其生效。
6.6.
For the purposes of this Article, "Parties present and voting" means Parties present and casting an affirmative or negative vote.为本条的目的,“出席并参加表决的缔约方”是指出席并投赞成票或反对票的缔约方。
ARTICLE 16第十六条
ADOPTION AND AMENDMENT OF ANNEXES TO THE CONVENTION公约附件的通过和修正
1.1.
Annexes to the Convention shall form an integral part thereof and, unless otherwise expressly provided, a reference to the Convention constitutes at the same time a reference to any annexes thereto.本公约的附件应构成本公约的组成部分,除另有明文规定外,凡提到本公约时即同时提到其任何附件。
Without prejudice to the provisions of Article 14, paragraphs 2(b) and 7, such annexes shall be restricted to lists, forms and any other material of a descriptive nature that is of a scientific, technical, procedural or administrative character.在不妨害第十四条第2款(b)项和第7款规定的情况下,这些附件应限于清单、表格和任何其他属于科学、技术、程序或行政性质的说明性资料。
2.2.
Annexes to the Convention shall be proposed and adopted in accordance with the procedure set forth in Article 15, paragraphs 2, 3 and 4.本公约的附件应按照第十五条第2、第3和第4款中规定的程序提出和通过。
3.3.
An annex that has been adopted in accordance with paragraph 2 above shall enter into force for all Parties to the Convention six months after the date of the communication by the Depositary to such Parties of the adoption of the annex, except for those Parties that have notified the Depositary, in writing, within that period of their non-acceptance of the annex.按照上述第2款通过的附件,应于保存人向公约的所有缔约方发出关于通过该附件的通知之日起六个月后对所有缔约方生效,但在此期间以书面形式通知保存人不接受该附件的缔约方除外。
The annex shall enter into force for Parties which withdraw their notification of non-acceptance on the ninetieth day after the date on which withdrawal of such notification has been received by the Depositary.对于撤回其不接受的通知的缔约方,该附件应自保存人收到撤回通知之日后第九十天起对其生效。
4.4.
The proposal, adoption and entry into force of amendments to annexes to the Convention shall be subject to the same procedure as that for the proposal, adoption and entry into force of annexes to the Convention in accordance with paragraphs 2 and 3 above.对公约附件的修正的提出、通过和生效,应依照上述第2和第3款对公约附件的提出、通过和生效规定的同一程序进行。
5.5.
If the adoption of an annex or an amendment to an annex involves an amendment to the Convention, that annex or amendment to an annex shall not enter into force until such time as the amendment to the Convention enters into force.如果附件或对附件的修正的通过涉及对本公约的修正,则该附件或对附件的修正应待对公约的修正生效之后方可生效。
ARTICLE 17第十七条
PROTOCOLS议定书
1.1.
The Conference of the Parties may, at any ordinary session, adopt protocols to the Convention.缔约方会议可在任何一届常会上通过本公约的议定书。
2.2.
The text of any proposed protocol shall be communicated to the Parties by the secretariat at least six months before such a session.任何拟议的议定书案文应由秘书处在举行该届会议至少六个月之前送交各缔约方。
3.3.
The requirements for the entry into force of any protocol shall be established by that instrument.任何议定书的生效条件应由该文书加以规定。
4.4.
Only Parties to the Convention may be Parties to a protocol.只有本公约的缔约方才可成为议定书的缔约方。
5.5.
Decisions under any protocol shall be taken only by the Parties to the protocol concerned.任何议定书下的决定只应由该议定书的缔约方作出。
ARTICLE 18第十八条
RIGHT TO VOTE表决权
1.1.
Each Party to the Convention shall have one vote, except as provided for in paragraph 2 below.除下述第2款所规定外,本公约每一缔约方应有一票表决权。
2.2.
Regional economic integration organizations, in matters within their competence, shall exercise their right to vote with a number of votes equal to the number of their member States that are Parties to the Convention.区域经济一体化组织在其权限内的事项上应行使票数与其作为本公约缔约方的成员国数目相同的表决权。
Such an organization shall not exercise its right to vote if any of its member States exercises its right, and vice versa.如果一个此类组织的任一成员国行使自己的表决权,则该组织不得行使表决权,反之亦然。
ARTICLE 19第十九条
DEPOSITARY保存人
The Secretary-General of the United Nations shall be the Depositary of the Convention and of protocols adopted in accordance with Article 17.联合国秘书长应为本公约及按照第十七条通过的议定书的保存人。
ARTICLE 20第二十条
SIGNATURE签署
This Convention shall be open for signature by States Members of the United Nations or of any of its specialized agencies or that are Parties to the Statute of the International Court of Justice and by regional economic integration organizations at Rio de Janeiro, during the United Nations Conference on Environment and Development, and thereafter at United Nations Headquarters in New York from 20 June 1992 to 19 June 1993.本公约应于联合国环境与发展会议期间在里约热内卢,其后自1992年6月20日至1993年6月19日在纽约联合国总部,开放供联合国会员国或任何联合国专门机构的成员国或《国际法院规约》的当事国和各区域经济一体化组织签署。
ARTICLE 21第二十一条
INTERIM ARRANGEMENTS临时安排
1.1.
The secretariat functions referred to in Article 8 will be carried out on an interim basis by the secretariat established by the General Assembly of the United Nations in its resolution 45/212 of 21 December 1990, until the completion of the first session of the Conference of the Parties.在缔约方会议第一届会议结束前,第八条所述的秘书处职能将在临时基础上由联合国大会1990年12月21日第45/212号决议所设立的秘书处行使。
2.2.
The head of the interim secretariat referred to in paragraph 1 above will cooperate closely with the Intergovernmental Panel on Climate Change to ensure that the Panel can respond to the need for objective scientific and technical advice.上述第1款所述的临时秘书处首长将与政府间气候变化专门委员会密切合作,以确保该委员会能够对提供客观科学和技术咨询的要求作出反应。
Other relevant scientific bodies could also be consulted.也可以咨询其他有关的科学机构。
3.3.
The Global Environment Facility of the United Nations Development Programme, the United Nations Environment Programme and the International Bank for Reconstruction and Development shall be the international entity entrusted with the operation of the financial mechanism referred to in Article 11 on an interim basis.在临时基础上,联合国开发计划署、联合国环境规划署和国际复兴开发银行的“全球环境融资”应为受托经营第十一条所述资金机制的国际实体。
In this connection, the Global Environment Facility should be appropriately restructured and its membership made universal to enable it to fulfil the requirements of Article 11.在这方面,“全球环境融资”应予适当改革,并使其成员具有普遍性,以使其能满足第十一条的要求。
ARTICLE 22第二十二条
RATIFICATION, ACCEPTANCE, APPROVAL OR ACCESSION批准、接受、核准或加入
1.1.
The Convention shall be subject to ratification, acceptance, approval or accession by States and by regional economic integration organizations.本公约须经各国和各区域经济一体化组织批准、接受、核准或加入。
It shall be open for accession from the day after the date on which the Convention is closed for signature.公约应自签署截止日之次日起开放供加入。
Instruments of ratification, acceptance, approval or accession shall be deposited with the Depositary.批准、接受、核准或加入的文书应交存于保存人。
2.2.
Any regional economic integration organization which becomes a Party to the Convention without any of its member States being a Party shall be bound by all the obligations under the Convention.任何成为本公约缔约方而其成员国均非缔约方的区域经济一体化组织应受本公约一切义务的约束。
In the case of such organizations, one or more of whose member States is a Party to the Convention, the organization and its member States shall decide on their respective responsibilities for the performance of their obligations under the Convention.如果此类组织的一个或多个成员国为本公约的缔约方,该组织及其成员国应决定各自在履行公约义务方面的责任。
In such cases, the organization and the member States shall not be entitled to exercise rights under the Convention concurrently.在此种情况下,该组织及其成员国无权同时行使本公约规定的权利。
3.3.
In their instruments of ratification, acceptance, approval or accession, regional economic integration organizations shall declare the extent of their competence with respect to the matters governed by the Convention.区域经济一体化组织应在其批准、接受、核准或加入的文书中声明其在本公约所规定事项上的权限。
These organizations shall also inform the Depositary, who shall in turn inform the Parties, of any substantial modification in the extent of their competence.此类组织还应将其权限范围的任何重大变更通知保存人,再由保存人通知各缔约方。
ARTICLE 23第二十三条
ENTRY INTO FORCE生效
1.1.
The Convention shall enter into force on the ninetieth day after the date of deposit of the fiftieth instrument of ratification, acceptance, approval or accession.本公约应自第五十份批准、接受、核准或加入的文书交存之日后第九十天起生效。
2.2.
For each State or regional economic integration organization that ratifies, accepts or approves the Convention or accedes thereto after the deposit of the fiftieth instrument of ratification, acceptance, approval or accession, the Convention shall enter into force on the ninetieth day after the date of deposit by such State or regional economic integration organization of its instrument of ratification, acceptance, approval or accession.对于在第五十份批准、接受、核准或加入的文书交存之后批准、接受、核准或加入本公约的每一国家或区域经济一体化组织,本公约应自该国或该区域经济一体化组织交存其批准、接受、核准或加入的文书之日后第九十天起生效。
3.3.
For the purposes of paragraphs 1 and 2 above, any instrument deposited by a regional economic integration organization shall not be counted as additional to those deposited by States members of the organization.为上述第1和第2款的目的,区域经济一体化组织所交存的任何文书不应被视为该组织成员国所交存文书之外的额外文书。
ARTICLE 24第二十四条

1.1.
At any time after three years from the date on which the Convention has entered into force for a Party, that Party may withdraw from the Convention by giving written notification to the Depositary.自本公约对一缔约方生效之日起三年后,该缔约方可随时向保存人发出书面通知退出本公约。

Any such withdrawal shall take effect upon expiry of one year from the date of receipt by the Depositary of the notification of withdrawal, or on such later date as may be specified in the notification of withdrawal.任何退出应自保存人收到退出通知之日起一年期满时生效,或在退出通知中所述明的更后日期生效。
3.3.
Any Party that withdraws from the Convention shall be considered as also having withdrawn from any protocol to which it is a Party.退出本公约的任何缔约方,应被视为亦退出其作为缔约方的任何议定书。

The original of this Convention, of which the Arabic, Chinese, English, French, Russian and Spanish texts are equally authentic, shall be deposited with the Secretary-General of the United Nations.本公约正本应交存于联合国秘书长,其阿拉伯文、中文、英文、法文、俄文和西班牙文文本同为作准。
