Recalling that the Universal Declaration of Human Rights and the International Covenants on Human Rights4 recognize that the ideal of free human beings enjoying freedom from fear and want can only be achieved if conditions are created whereby everyone may enjoy civil, cultural, economic^ political and social rights,忆及《世界人权宣言》和国际人权两公约确认,只有创造条件,使人人都可以享有公民、文化、经济、政治和社会权利,才能实现自由人类免于恐惧和匮乏的理想,

Recalling that each State Party to the International Covenant on Economic, Social and Cultural Rights'1 (hereinafter referred to as "the Covenant") undertakes to take steps, individually and through international assistance and cooperation, especially economic and technical, to the maximum of its available resources, with a view to achieving progressively the full realization of the rights recognized in the Covenant by all appropriate means, including particularly the adoption of legislative measures,忆及《经济、社会、文化权利国际公约》(下称“《公约》”)每一缔约国承诺单独采取步骤或通过国际援助和合作,特别是经济和技术援助和合作,釆取步骤,尽最大能力,采用一切适当方法,尤其是包括采用立法措施,逐步争取充分实现《公约》所承认的权利,
Considering that, in order further to achieve the purposes of the Covenant and the implementation of its provisions, it would be appropriate to enable the Committee on Economic, Social' and Cultural Rights (hereinafter referred to as "the Committee") to carry out the functions provided for in the present Protocol,考虑到为进一步实现《公约》的宗旨,落实《公约》各项规定,应设法使经济、社会和文化权利委员会(下称“委员会”)能够履行本议定书规定的职能,
Have agreed as follows:议定如下:
Article 1第一条
Competence of the Committee to receive and consider communications委员会接受和审议来文的权限
1. A State Party to the Covenant that becomes a Party to the present Protocol recognizes the competence of the Committee to receive and consider communications as provided for by the provisions of the present Protocol.一、成为本议定书缔约方的《公约》缔约国承认委员会有权根据本议定书条款的规定接受和审议来文。
2. No communication shall be received by the Committee if it concerns a State Party to the Covenant which is not a Party to the present Protocol.二、委员会不得接受涉及非本议定书缔约方的《公约》缔约国的来文。
Article 2第二条
Communications来文
Communications may be submitted by or on behalf of individuals or groups of individuals, under the jurisdiction of a State Party, claiming to be victims of a violation of any of the economic, social and cultural rights set forth in the Covenant by that State Party.来文可以由声称因一缔约国侵犯《公约》所规定的任何经济、社会和文化权利而受到伤害的该缔约国管辖下的个人自行或联名提交或以其名义提交。
Where a communication is submitted on behalf of individuals or groups of individuals, this shall be with their consent unless the author can justify acting on their behalf without such consent.代表个人或联名个人提交来文,应当征得当事人的同意,除非来文人能说明未经当事人同意而代为提交的正当理由。
Article 3第三条
Admissibility可受理性
1. The Committee shall not consider a communication unless it has ascertained that all available domestic remedies have been exhausted.一、除非委员会已确定一切可用的国内补救办法均已用尽,否则委员会不得审议来文。
This shall not be the rule where the application of such remedies is unreasonably prolonged.如果补救办法的应用被不合理地拖延,本规则不予适用。
2. The Committee shall declare a communication inadmissible when:二、来文有下列情形之一的,委员会应当宣布为不可受理:
(a) It is not submitted within one year after the exhaustion of domestic remedies, except in cases where the author can demonstrate that it had not been possible to submit the communication within that time limit;㈠未在用尽国内补救办法后一年之内提交,但来文人能证明在此时限内无法提交来文的情况除外;
(b) The facts that are the subject of the communication occurred prior to the entry into force of the present Protocol for the State Party concerned unless those facts continued after that date;㈡所述事实发生在本议定书对有关缔约国生效之前,除非这些事实存续至生效之日后;
(c) The same matter has already been examined by the Committee or has been or is being examined under another procedure of international investigation or settlement;㈢同一事项业经委员会审查或已由或正由另一国际调查或解决程序审查;
(d) It is incompatible with the provisions of the Covenant;㈣不符合《公约》的规定;
(e) It is manifestly ill-founded, not sufficiently substantiated or exclusively based on reports disseminated by mass, media;㈤明显没有根据或缺乏充分证据,或仅以大众媒体传播的报道为根据;
(f) It is an abuse of the right to submit a communication; or when㈥滥用提交来文的权利;或
(g) It is anonymous or not In writing.㈦采用匿名形式或未以书面形式提交。
Article 4第四条
Communications not revealing a clear disadvantage未显示处境明显不利的来文
The Committee may, if necessary, decline to consider a communication where it does not reveal that the author has suffered a clear disadvantage, unless the Committee considers that the communication raises a serious issue of general importance.委员会必要时可以对未显示来文人处于明显不利境况的来文不予审议,除非委员会认为来文提出了具有普遍意义的严重问题。
Article 5第五条
Interim measures临时措施
1. At any time after the receipt of a communication and before a determination on the merits has been reached, the Committee may transmit to the State Party concerned for its urgent consideration a request that the State Party take such interim measures as may be necessary in exceptional circumstances to avoid possible irreparable damage to the victim or victims of the alleged violations.一、委员会收到来文后,在对实质问题作出裁断前,可以随时向有关缔约国发出请求,请该国从速考虑根据特殊情况采取必要的临时措施,以避免对声称权利被侵犯的受害人造成可能不可弥补的损害。
2. Where the Committee exercises its discretion under paragraph 1 of the present article, this does not imply a determination on admissibility or on the merits of the communication.二、委员会根据本条第一款行使酌处权,并不意味对来文的可受理性或实质问题作出裁断。
Article 6第六条
Transmission of the communication转交来文
1. Unless the Committee considers a communication inadmissible without reference to the State Party concerned, the Committee shall bring any communication submitted to it under the present Protocol confidentially to the attention of the State Party concerned.一、除非委员会认定来文不可受理,不送交有关缔约国,否则任何根据本议定书提交委员会的来文,委员会均应当以保密方式提请有关缔约国注意。
2. Within six months, the receiving State Party shall submit to the Committee written explanations or statements clarifying the matter and the remedy, If any, that may have been provided by that State Party.二、收文缔约国应当在六个月内向委员会提交书面解释或陈述,澄清有关事项及该缔约国可能已提供的任何补救办法。
Article 7第七条
Friendly settlement友好解决
1. The Committee shall make available its good offices to the parties concerned with a view to reaching a friendly . settlement of the matter on the basis of the respect for the obligations set forth in the Covenant.一、委员会应当向有关当事方提供斡旋,以期在尊重《公约》规定的义务的基础上友好解决有关问题。
2. An agreement on a friendly settlement closes consideration of the communication under the present Protocol.二、一旦达成友好解决协定,根据本议定书提交的来文审议工作即告结束。
Article 8第八条
Examination of communications审查来文
1. The Committee shall examine communications received under article 2 of the present Protocol in the light of all documentation submitted to it, provided that this documentation is transmitted to the parties concerned.一、委员会应当根据提交委员会的全部文件资料审查根据本议定书第二条收到的来文,但这些文件资料应当送交有关当事方。
2. The Committee shall hold closed meetings when examining communications under the present Protocol.二、委员会应当通过非公开会议审查根据本议定书提交的来文。
3. When examining a communication under the present Protocol,, the Committee may consult, as appropriate, relevant documentation emanating from other United Nations bodies, specialized agencies, funds, programmes and mechanisms, and other international organizations, including from regional human rights systems, and any observations or comments by the State Party concerned.三、委员会在审查根据本议定书提交的来文时,可以酌情查阅其他联合国机构、专门机构、基金、方案和机制及包括区域人权系统在内的其他国际组织的相关文件资料,以及有关缔约国的任何意见或评论。
4. When examining communications under the present Protocol, the Committee shall consider the reasonableness of the steps taken by the Slate Party in accordance with part II of the Covenant.四、委员会在审查根据本议定书提交的来文时,应当审议缔约国依照《公约》第二部分规定采取的步骤的合理性。
In doing so, the Committee shall bear in mind that the State Party may adopt a range of possible policy measures for the implementation of the rights set forth in the Covenant.在这方面,委员会应当注意到缔约国可以为落实《公约》规定的权利而可能采取的多种政策措施。
Article 9第九条
Follow-up to the views of the Committee委员会意见的后续行动
1. After examining a communication, the Committee shall transmit its views on the communication, together with its recommendations, if any, to the parties concerned.一、委员会在审查来文后,应当向有关当事方传达委员会对来文的意见及可能提出的任何建议。
2. The State Party shall give due consideration to the views of the Committee, together with its recommendations, if any, and shall submit to the Committee, within six months, a written response, including information on any action taken in the light of the views and recommendations of the Committee.二、缔约国应当适当考虑委员会的意见及可能提出的建议,并应当在六个月内向委员会提交书面答复,包括通报根据委员会意见和建议采取的任何行动。
3. The Committee may invite the State Party to submit further information about any measures the State Party has taken in response to its views or recommendations, if any, including as deemed appropriate by the Committee, in the State Party's subsequent reports under articles 16 and 17 of the Covenant.三、委员会可以邀请缔约国就委员会的意见或建议所可能采取的任何措施提供进一步资料,包括在委员会认为适当的情况下,在缔约国随后根据《公约》第十六条和第十七条提交的报告中提供这些资料。
Article 10第十条
Inter-State communications国家间来文
1. A State Party to the present Protocol may at any time declare under the present article that it recognizes the competence of the Committee to receive and consider communications to the effect that a State Party claims that another State Paity is not fulfilling its obligations under the Covenant.一、本议定书缔约国可以在任何时候根据本条作出声明,承认委员会有权接受和审议涉及一缔约国声称另一缔约国未履行《公约》所规定义务的来文。
Communications under the present article may be received and considered only if submitted by a State Party that has made a declaration recognizing in regard to itself the competence of the Committee.根据本条规定提交来文的缔约国须已声明本国承认委员会有此权限,委员会方可接受和审议此种来文。
No communication shall be received by the Committee if it concerns a State Party which has not made such a declaration.来文涉及尚未作出这种声明的缔约国的,委员会不得予以接受。
Communications received under the present article shall be dealt with in accordance with the following procedure:根据本条规定接受的来文,应当按下列程序处理:
(a) If a State Party to the present Protocol considers that another State Party is not fulfilling its obligations under the Covenant, it may, by written communication, bring the matter to the attention of that State Party. The State Party may also inform the Committee of the matter.(一)本议定书一缔约国如果认为另一缔约国未履行《公约》规定的义务,可以用书面函件提请该缔约国注意此事,也可以将此事通知委员会。
Within three months after the receipt of the communication, the receiving State shall afford the State that sent the communication an explanation, or any other statement in writing clarifying the matter, which should include, to the extent possible and pertinent, reference to domestic procedures and remedies taken, pending or available in the matter;收函国在收到函件后三个月内,应当以书面形式向发函国作出解释或其他陈述,澄清此事,其中应当尽可能和具体地提及已经对此事,即将对此事或可以对此事采取的国内程序和补救办法;
(b) If the matter is not settled to the satisfaction of both States Parties concerned within six months after the receipt by the receiving State of the initial communication, either State shall have the right to refer the matter to the Committee, by notice given to the Committee and to the other State;(二)如果在收函国收到最初函件后六个月内,有关事项尚未达成有关缔约国双方满意的解决,任何一方均有权以通知委员会和另一方的方式将此事提交委员会;
(c) The Committee shall deal with a matter referred to it only after it has ascertained that all available domestic remedies have been invoked and exhausted in the matter.(三)对于提交委员会的事项,委员会只有在确定已经就该事援用并用尽一切可用的国内补救办法后,方可予以处理。
This shall not be the rule where the application of the remedies is unreasonably prolonged;如果补救办法的应用被不合理地拖延,本规则不予适用;
(d) Subject to the provisions of subparagraph (c) of the present paragraph, the Committee shall make available its good offices to the States Parties concerned with a view to a friendly solution of the matter on the basis of the respect for the obligations set forth in the Covenant;(四)在不违反本款第(三)项规定的情况下,委员会应当向有关缔约国提供斡旋,以期在尊重《公约》规定的义务的基础上友好地解决有关事项;
(e) The Committee shall hold closed meetings when examining communications under the present article;(五)委员会应当举行非公开会议审查根据本条提交的来文;
(f) In any matter referred to it in accordance with subparagraph (6) of the present paragraph, the Committee may call upon the States Parties concerned, referred to in subparagraph (6), to supply any relevant information;(六)对于依照本款第(二)项规定提交的任何事项,委员会可以要求第(二)项所提的有关缔约国提供任何相关资料;
(g) The States Parties concerned, referred to in subparagraph (b) of the present paragraph, shall have the right to be represented when the matter is being considered by the Committee and to make submissions orally and/or in writing;(七)委员会审议有关事项时,本款第(二)项所提的有关缔约国有权派代表出席并提出口头和(或)书面意见;
(h) The Committee shall, with all due expediency after the date of receipt of notice under subparagraph (b) of tlie present paragraph, submit a report, as follows:(八)委员会应当在收到本款第(二)项规定的通知之日后尽可能适当地权宜行事,按照下列方式提出报告:
(i) If a solution within the terms of subparagraph (d) of the present paragraph is reached, the Committee shall confine its report to a brief statement of the facts and of the solution reached;1.如果按本款第(四)项规定达成解决办法,委员会的报告应当限于简要陈述事实及所达成的解决办法;
(ii) If a solution within the terms of subparagraph (d) is not reached, the Committee shall, in its report, set forth the relevant facts concerning the issue between the States Parties concerned, The written submissions and record of the oral submissions made by the States Parties concerned shall be attached to the report.2.如果未能按本款第(四)项规定达成解决办法,委员会的报告应当列举与有关缔约国之间问题相关的事实。 有关缔约国的书面意见及口头意见记录应当附于报告之内。
The Committee may also communicate only to the States Parties concerned any views that it may consider relevant to the issue between them.委员会也可以只向有关缔约国提出委员会认为与两国之间的问题相关的意见。
In every matter, the report shall be communicated to the States Parties concerned.在上述情况下,报告应当送交有关缔约国。
2. A declaration under paragraph 1 of the present article shall be deposited by the States Parties with the Secretary-General of the United Nations, who shall transmit copies thereof to the other States Parties.二、根据本条第一款作出的声明,应当由缔约国交存联合国秘书长,由秘书长将声明副本分送其他缔约国。
A declaration may be withdrawn at any time by notification to the Secretary-General, Such a withdrawal shall not prejudice the consideration of any matter that is the subject of a communication already transmitted under the present article; no further communication by any State Party shall be received under the present article after the notification of -withdrawal of tlie declaration has been received by the Secretary-General, unless the State Party concerned has made a new declaration.任何声明可随时以通知秘书长的方式予以撤回。 撤回不得妨碍对业已根据本条发出的来文所涉任何事项的审议;在秘书长收到撤回声明的通知后,除非有关缔约国作出新的声明,否则不得再接受任何缔约国根据本条提交的其他来文。
Article 11第十一条
Inquiry procedure调查程序
1. A State Party to the present Protocol may at any time declare that it recognizes the competence of the Committee provided for under the present article.一、本议定书缔约国可以在任何时候作出声明,承认本条规定的委员会权限。
2. If the Committee receives reliable information indicating grave or systematic violations by a State Party of any of the economic, social and cultural lights set forth in the Covenant, the Committee shall invite that State Party to cooperate in the examination of the information and to this end to submit observations with regard to the information concerned.二、如果委员会收到可靠资料,显示某一缔约国严重或有系统地侵犯《公约》规定的任何经济、社会和文化权利,委员会应当邀请该缔约国合作研究这些资料,并为此就有关资料提出意见。
3. Taking into account any observations that may have been submitted by the State Party concerned as well as any other reliable information available to it, the Committee may designate one or more of its members to conduct an inquiry and to report urgently to the Committee.三、在考虑有关缔约国可能提出的任何意见以及委员会掌握的任何其他可靠资料后,委员会可以指派一名或多名成员进行调查,从速向委员会报告。
Where warranted and with the consent of the State Party, the inquiry may include a visit to its territory.必要时,在征得有关缔约国同意后,调查可以包括前往该国领土访问。
4. Such an inquiry shall be conducted confidentially and the cooperation of the State Party shall be sought at all stages of the proceedings.四、调查应当以保密方式进行,并应当在程序的各个阶段寻求有关缔约国的合作。
5. After examining the findings of such an inquiry, the Committee shall transmit these findings to the State Party concerned together with any comments and recommendations.五、对调查结果进行审查后,委员会应当将调查结果连同任何评论和建议一并送交有关缔约国。
6. The State Party concerned shall, within six months of receiving the findings, comments and recommendations transmitted by the Committee, submit its observations to the Committee.六、有关缔约国应当在收到委员会送交的调查结果、评论和建议后六个月内,向委员会提交本国意见。
7. After such proceedings have been completed with regard to an inquiry made in accordance with paragraph 2 of the present article, the Committee may, after consultations with the State Party concerned, decide to include a summary account of the results of the proceedings in its annual report provided for in article 15 of the present Protocol.七、依照本条第二款规定进行的调查程序结束后,委员会经与有关缔约国协商,可以决定在本议定书第十五条规定的委员会年度报告中摘要介绍程序结果。
8. Any State Party having made a declaration in accordance with paragraph 1 of the present article may, at any time, withdraw this declaration by notification to the Secretary-General,八、依照本条第一款规定作出声明的任何缔约国,可以随时通知秘书长撤回其声明。
Article 12第十二条
Follow-up to the inquiry procedure调查程序的后续行动
1. The Committee may invite the State Party concerned to include in its report under articles 16 and 17 of the Covenant details of any measures taken in response to an inquiry conducted under article 11 of the present Protocol.一、委员会可以邀请有关缔约国在其根据《公约》第十六条和第十七条提交的报告中,详述就根据本议定书第十一条进行的调查所采取的任何措施。
2. The Committee may, if necessary, after the end of the period of six months referred to in article 11, paragraph 6, invite the State Parry concerned to inform it of the measures taken in response to such an inquiry.二、必要时,委员会可以在第十一条第六款所述六个月期间结束后,邀请有关缔约国向委员会通报该国就调查所采取的措施。
Article 13第十三条
Protection measures保护措施
A State Party shall take all appropriate measures to ensure that individuals under its jurisdiction are not subjected to any form of ill-treatment or intimidation as a consequence of communicating with the Committee pursuant to the present Protocol.缔约国应当采取一切适当措施,确保在其管辖下的个人不会因为根据本议定书与委员会联络而受到任何形式的不当待遇或恐吓。
Article 14第十四条
International assistance and cooperation国际援助与合作
1. The Committee shall transmit, as it may consider appropriate, and with the consent of the State Party concerned, to United Nations specialized agencies, funds and programmes and other competent bodies, its views or recommendations concerning communications and inquiries that indicate a need for technical advice or assistance, along with the State Party's observations and suggestions, if any, on these views or recommendations.一、对于显示有必要获得技术咨询或协助的来文和调查,委员会应当酌情在征得有关缔约国同意后,将委员会的意见或建议,连同缔约国可能就这些意见或建议提出的意见和提议,送交联合国各专门机构、基金和方案以及其他主管机构。
2. The Committee may also bring to the attention of such bodies, with the consent of (he State Parry concerned, any matter arising out of communications considered under the present Protocol which may assist them in deciding, each within its field of competence, on the advisability of international measures likely to contribute to assisting States Parties in achieving progress in implementation of the rights recognized in the Covenant.二、委员会也可以在征得有关缔约国同意后,提请上述机构注意任何根据本议定书审议的来文所引起的事项;此种事项可以协助它们在各自权限范围内决定是否应当采取可能具有促进作用的国际措施,以协助各缔约国在落实《公约》确认的权利方面取得进展。
3. A trust fund shall be established in accordance with tie relevant procedures of the General Assembly, to be administered in accordance with the Financial Regulations and Rules of the United Nations, with a view to providing expert and technical assistance to States Parties, with the consent of the State Parly concerned, for the enhanced implementation of the rights contained in the Covenant, thus contributing to building national capacities in the area of economic, social and cultural rights in the context of the present Protocol.三、应当依照大会相关程序设立一个依照联合国财务条例和细则规定管理的信托基金,以期在征得有关缔约国同意后,向缔约国提供专家和技术援助,加强《公约》所载权利的落实,推动根据本议定书在经济、社会和文化权利领域进行国家能力建设。
4. The provisions of the present article are without prejudice to the obligations of each State Party to fulfil its obligations under the Covenant.四、本条规定不妨碍各缔约国履行《公约》规定的义务。
Article 15第十五条
Annual report年度报告
The Committee shall include In its annual report a summary of its activities under the present Protocol.委员会的年度报告应当摘要介绍根据本议定书开展的活动。
Article 16第十六条
Dissemination and information传播与信息
Each State Party undertakes to make widely known and to disseminate the Covenant and the present Protocol and to facilitate access to .information about the /views and recommendations of the Committee, in particular, on matters involving that State Party, and to do so in accessible formats for persons with disabilities.各缔约国承诺广泛宣传和传播《公约》及本议定书,为获得信息以了解委员会的意见和建议,特别是涉及本国的事项的意见和建议提供便利,并在这方面以无障碍模式向残疾人提供信息。
Article 17第十七条
Signature, ratification and accession签署、批准和加入
1. The present Protocol is open for signature by any State that has signed, ratified or acceded to the Covenant.一、本议定书开放供任何已签署、批准或加入《公约》的国家签署。
2. The present Protocol is subject to ratification by any State that has ratified or acceded to the Covenant.二、本议定书须经已批准或加入《公约》的国家批准。
Instruments of ratification shall be deposited with the Secretary-General of the United Nations.批准书交存联合国秘书长。
3. The present Protocol shall be open to accession by any State that has ratified or acceded to the Covenant.三、本议定书开放供任何已批准或加入《公约》的国家加入。
4. Accession shall be effected by the deposit of an instrument of accession with the Secretary-General of the United Nations.四、向联合国秘书长交存加入书后,加入即行生效。
Article 18第十八条
Entry into force生效
1. The present Protocol shall enter into force three months after the date of the deposit with the Secretary-General of the United Nations of the tenth instrument of ratification or accession.一、本议定书在第十份批准书或加入书交存联合国秘书长之日起三个月后生效。
2, For each State ratifying or acceding to the present Protocol after the deposit of the tenth instrument of ratification or accession, the Protocol shall enter into force three months after the date of the deposit of its instrument of ratification or accession.二、对于在第十份批准书或加入书交存后批准或加入议定书的国家,议定书在该国交存批准书或加入书之日起三个月后生效。
Article 19第十九条
Amendments修正
1. Any State Party may propose an amendment to the present Protocol and submit it to the Secretary-General of the United Nations.一、任何缔约国均可以对本议定书提出修正案,提交联合国秘书长。
The Secretary-General shall communicate any proposed amendments to States Parties, with a request to be notified whether they favour a meeting of States Parties for the purpose of considering and deciding upon the proposals.秘书长应当将任何提议的修正案通告各缔约国,请缔约国通知秘书长,表示是否赞成召开缔约国会议对提案进行审议和作出决定。
In the event that, within four months from the date of such communication, at least one third of the States Parties favour such a meeting, the Secretary-General shall convene the meeting under the auspices of the United Nations.在上述通告发出之日起四个月内,如果有至少三分之一的缔约国赞成召开缔约国会议,秘书长应当在联合国主持下召开会议。
Any amendment adopted by a majority of two thirds of the States Parties present and voting shall be submitted by the Secretary-General to the General Assembly for approval and thereafter to all States Parties for acceptance.经出席并参加表决的缔约国三分之二多数通过的任何修正案,应当由秘书长提交联合国大会核准,然后提交所有缔约国接受。
2. An amendment adopted and approved in accordance with paragraph 1 of the present article shall enter into force on the thirtieth day after the number of instruments of acceptance deposited reaches two thirds of the number of States Parties at the date of adoption of the amendment.二、依照本条第一款的规定通过并核准的修正案,应当在交存的接受书数目达到修正案通过之日缔约国数目的三分之二后第三十天生效。
Thereafter, the amendment shall enter into force for any State Party on the thirtieth day following the deposit of Its own instrument of acceptance.此后,修正案应当在任何缔约国交存其接受书后第三十天对该缔约国生效。
An amendment shall be binding only on those States Parties which have accepted it.修正案只对接受该项修正案的缔约国具有约束力。
Article 20第二十条
Denunciation退约
1. Any State Party may denounce the present Protocol at any time by written notification addressed to the Secretary-General of the United Nations.一、缔约国可以随时书面通知联合国秘书长退出本议定书。
Denunciation shall take effect six months after the date of receipt of the notification by the Secretary-General.退约应当在秘书长收到通知之日起六个月后生效。
2. Denunciation shall be without prejudice to the continued application of the provisions of the present Protocol to any communication submitted under articles 2 and 10 or to any procedure initiated under article 11 before the effective date of denunciation.二、退约不妨碍本议定书各项规定继续适用于退约生效之日前根据第二条和第十条提交的任何来文,以及退约生效之日前根据第十一条启动的任何程序。
Article 21第二十一条
Notification by the Secretary-General秘书长的通知
The Secretary-General of the United Nations shall notify all States referred to in article 26, paragraph 1, of the Covenant of the following particulars:联合国秘书长应当将下列具体情况通知《公约》第二十六条第一款所提的所有国家:
(a) Signatures, ratifications and accessions under the present Protocol;(一)本议定书的签署、批准和加入;
(b) The date of entry into force of the present Protocol and of any amendment under article 19;(二)本议定书和任何根据第十九条提出的修正案的生效日期;
(c) Any denunciation under article 20.(三)任何根据第二十条发出的退约通知。

Official languages正式语文
1. The present Protocol, of which the Arabic, Chinese, English, French, Russian and Spanish texts are equally authentic, shall be deposited In the archives of the United Nations.一、本议定书应当交存联合国档案库,其阿拉伯文、中文、英文、法文、俄文和西班牙文文本同等作准。
2. The Secretary-General of the United Nations shall -transmit certified copies of the present Protocol to all States referred to in article 26 of the Covenant.二、联合国秘书长应当将本议定书经证明无误的副本分送《公约》第二十六条所提的所有国家。
