Article 1. General Obligations第1条.—般义务

Each State Party undertakes never under any circumstances:每一缔约国承诺在任何情况下,决不:

(b)(b)
To develop, produce, otherwise acquire, stockpile, retain or transfer to anyone, directly or indirectly, anti-personnel mines;发展、生产、以其他方式获取、储存、保留或者直接或间接向任何人转让杀伤人员地雷;

Each State Party undertakes to destroy or ensure the destruction of all anti-personnel mines in accordance with the provisions of this Convention.每一缔约国承诺按照本公约的规定,销毁或确保销毁所有杀伤人员地雷。
Article 2. Definitions第2条 定义
1.1.
"Anti-personnel mine" means a mine designed to be exploded by the presence, proximity or contact of a person and that will incapacitate, injure or kill one or more persons.“杀伤人员地雷”是指设计成在人员出现、接近或接触时爆炸而使一名或 一名以上人员丧失能力、受伤或死亡的一种地雷。

2.2.

Article 3. Exceptions第3条.例外

Notwithstanding the general obligations under Article I, the retention or transfer of a number of anti-personnel mines for the development of and training in mine detection, mine clearance, or mine destruction techniques is permitted.虽有笫1条规定的一般义务,但为发展探雷,扫雷或销毁地雷的技术和进行这些方面的训练而保留或转让一定数量的杀伤人员地雷是允许的。

Article 4. Destruction of Stockpiled Anti-Personnel Mines第4条.销毁储存中的杀伤人员地雷
Except as provided for in Article 3, each State Party undertakes to destroy or ensure the destruction of all stockpiled anti-personnel mines it owns or possesses, or that are under its jurisdiction or control, as soon as possible but not later than four years after the entry into force of this Convention for that State Party.除第3条规定者外,每一缔约国承诺尽快地,但至迟在本公约对该缔约国生效后4年内,销毁或确保销毁其所储存的属其所有或拥有,或在其管辖或控制下的所有杀伤人员地雷。
Article 5. Destruction of Anti-Personnel Mines in Mined Areas第5条.销毁雷区内的杀伤人员地雷
1.1.
Each State Party undertakes to destroy or ensure the destruction of all anti-personnel mines in mined areas under its jurisdiction or control, as soon as possible but not later than ten years after the entry into force of this Convention for that State Party.每一缔约国承诺尽快地,但至迟在本公约对该缔约国生效后10年内,销毁或确保销毁在其管辖或控制下的雷区内的所有杀伤人员地雷。
2.2.
Each State Party shall make every effort to identify all areas under its jurisdiction or control in which anti-personnel mines are known or suspected to be emplaced and shall ensure as soon as possible that all anti-personnel mines in mined areas under its jurisdiction or control are perimeter-marked, monitored and protected by fencing or other means, to ensure the effective exclusion of civilians, until all anti-personnel mines contained therein have been destroyed.每一缔约国应尽其努力,查明在其管辖或控制下所有已知或怀疑布设了杀伤人员地雷的地区,并应确保尽快标明在其管辖或控制下的所有杀伤人员地雷雷区的周边界线,加以监视,并用围栏或其他方式保护起来,以确保有效地阻止平民进入,直至雷区内的杀伤人员地雷已被全部销毁。
The marking shall at least be to the standards set out in the Protocol on Prohibitions or Restrictions on the Use of Mines, Booby-Traps and Other Devices, as amended on 3 May 1996, annexed to the Convention on Prohibitions or Restrictions on the Use of Certain Conventional Weapons Which May Be Deemed to Be Excessively Injurious or to Have Indiscriminate Effects.所作的标记应至少达到作为《禁止或限制使用某些可被认为具有过分伤害力或滥杀滥伤作用的常规武器公约》附件,并于1996 年5月3日作了修正的《禁止或限制使用地雷、诱杀装置和其他装置的议定书》所规定的标准。
3. If a State Party believes that it will be unable to destroy or ensure the destruction of all anti-personnel mines referred to in paragraph 1 within that time period, it may submit a request to a Meeting of the States Parties or a Review Conference for an extension of the deadline for completing the destruction of such anti-personnel mines, for a period of up to ten years.—个缔约国如果认为自己无法在规定的时间内销毁或确保销毁本条第1款所述的杀伤人员地雷,可以向一次缔约国会议或审议会议提出延长完成销毁期限的请求,最多可延长10年时间。
4. Each request shall contain:每一项请求应载有:
(a) The duration of the proposed extension;(a)提议延长的期限;
(b) A detailed explanation of the reasons for the proposed extension, including:(b)详细解释提议延长期限的理由,包括:
(1) The preparation and status of work conducted under national demining programs;(一)在本国扫雷方案下所做工作的筹备和进行情况;
(2) The financial and technical means available to the State Party for the destruction of all the anti- personnel mines; and(二)可供该缔约国销毁所有杀伤人员地雷的资金和技术手段;和
(3) Circumstances which impede the ability of the State Party to destroy all the antipersonnel mines in mined areas(三) 阻碍该缔约国销毁雷区内所有杀伤人员地雷能力的情况;
(c) The humanitarian, social, economic, and environmental implications of the extension;(c)延长期限所涉及的人道主义、社会、经济和环境问题;
and

5. The Meeting of the States Parties or the Review Conference shall, taking into consideration the factors contained in paragraph 4, assess the request and decide by a majority of votes of States Parties present and voting whether to grant the request for an extension period.5. 缔约国会议或审议会议应考虑到第4款所述各种因素,评估该项请求,以超过出席并参加表决的缔约国的半数票决定是否批准延长期限的请求。
6. Such an extension may be renewed upon the submission of a new request in accordance with paragraphs 3, 4 and 5 of this Article. Article 6.第6条.
International Cooperation and Assistance国际合作和援助
1.1.
In fulfilling its obligations under this Convention each State Party has the right to seek and receive assistance, where feasible, from other States Parties to the extent possible.每一缔约国在履行其在本公约下的义务时,在可行情况下,有权寻求和接受其他缔约国在可能范围内提供的援助。
2.2.
Each State Party undertakes to facilitate and shall have the right to participate in the fullest possible exchange of equipment, material and scientific and technological information concerning the implementation of this Convention.每一缔约国承诺促进并应有权参加与本公约执行有关的设备、物资以及科学和技术资料尽可能充分的交换。
The States Parties shall not impose undue restrictions on the provision of mine clearance equipment and related technological information for humanitarian purposes.缔约国不应对出于人道主义目的提供扫雷设备和有关技术资料施加不应有的限制。
3. Each State Party in a position to do so shall provide assistance for the care and rehabilitation, and social and economic reintegration, of mine victims and for mine awareness programmes. Such assistance may be provided, inter alia, through the United Nations system, international, regional or national organizations or institutions, the International Committee of the Red Cross, national Red Cross and Red Crescent societies and their International Federation, non-governmental organizations, or on a bilateral basis.每一个有能力这样做的缔约国应为照顾受地雷伤害的人,帮助他们康复及重新融入社会和经济生活,和实施防雷宣传方案提供援助。这种援助除其他外,可以通过联合国系统、各种国际性、区域性或各国的组织或机构、红十字国际委员会、各国的红十字会、红新月会及它们的国际联合会和非政府组织提供,或在双边基础上提供。
4. Each State Party in a position to do so shall provide assistance for mine clearance and related activities. Such assistance may be provided, inter alia, through the United Nations system, international or regional organizations or institutions, non-governmental organizations or institutions, or on a bilateral basis, or by contributing to the United Nations Voluntary Trust Fund for Assistance in Mine Clearance, or other regional funds that deal with demining.每一个有能力这样做的缔约国应为扫雷和相关活动提供援助。 这种援助除其他外,可以通过联合国系统、各种国际性或区域性组织或机构、非政府组织或机构提供,或在双边基础上提供,或者采取向联合国扫雷援助自愿基金或其他用于扫雷的区域性基金捐款的方式。

6. Each State Party undertakes to provide information to the database on mine clearance established within the United Nations system, especially information concerning various means and technologies of mine clearance, and lists of experts, expert agencies or national points of contact on mine clearance.6. 每一缔约国承诺向在联合国系统内建立的扫雷数据库提供资料,特别是关于各种扫雷手段和技术的资料,以及扫雷方面的专家、专家机构或国家联络点名单。
7.7.
States Parties may request the United Nations, regional organizations, other States Parties or other competent intergovernmental or non-governmental fora to assist its authorities in the elaboration of a national demining program to determine, inter alia:缔约国可以请求联合国、区域性组织、其他缔约国或其他主管的政府间或非政府论坛协助其当局拟定国家扫雷方案,以便除其他外,确定:

Mine awareness activities to reduce the incidence of mine-related injuries or deaths;旨在减少地雷相关伤亡的发生率的防雷宣传活动;

The relationship between the Government of the concerned State Party and the relevant governmental, intergovernmental or non-governmental entities that will work in the implementation of the program.该缔约国政府与将参与执行扫雷方案的有关政府、政府间或非政府实体之间的关系。

Each State Party giving and receiving assistance under the provisions of this Article shall cooperate with a view to ensuring the full and prompt implementation of agreed assistance programs.按照本条规定提供和接受援助的每一个缔约国应进行合作,以确保商定的援助方案得到迅速充分的执行。
Article 7.第7条.
Transparency Measures透明措施
1.1.
Each State Party shall report to the Secretary-General of the United Nations as soon as practicable, and in any event not later than 180 days after the entry into force of this Convention for that State Party on:每一缔约国应在可行的情况下尽快地,但无论如何至迟在本公约对该缔约国生效后180天内,就下列事项向联合国秘书长提出报告:

The national implementation measures referred to in Article 9;第9条所述的国家执行措施;
(b)(b)
The total of all stockpiled anti-personnel mines owned or possessed by it, or under its jurisdiction or control, to include a breakdown of the type, quantity and, if possible, lot numbers of each type of anti- personnel mine stockpiled;它所储存的属其所有或拥有、或在其管辖或控制下的所有杀伤人员地雷总数,包括分类列出所储存的每一种杀伤人员地雷的型号和数量,可能的话并列出其批号;

The types, quantities and, if possible, lot numbers of all anti-personnel mines retained or transferred for the development of and training in mine detection, mine clearance or mine destruction techniques, or transferred for the purpose of destruction, as well as the institutions authorized by a State Party to retain or transfer anti-personnel mines, in accordance with Article 3;根据第3条为发展探雷、扫雷或销毁地雷的技术和进行这些方面的训练而保留或转让的,或为销毁目的而转让的所有杀伤人员地雷的型号和数量,可能的话并列出其批号,以及缔约国授权保留或转让杀伤人员地雷的机构;

The types and quantities of all anti-personnel mines destroyed after the entry into force of this Convention for that State Party, to include a breakdown of the quantity of each type of anti-personnel mine destroyed, in accordance with Articles 4 and 5, respectively, along with, if possible, the lot numbers of each type of anti-personnel mine in the case of destruction in accordance with Article 4;本公约对该缔约国生效后已经销毁的所有杀伤人员地雷的型号和数量,包括分类列出已分别按照第4条和第5条销毁的每一种杀伤人员地雷的数量,可能的话并列出按照第4条销毁的每一种杀伤人员地雷的批号;

2.2.
The information provided in accordance with this Article shall be updated by the States Parties annually, covering the last calendar year, and reported to the Secretary-General of the United Nations not later than 30 April of each year.按照本条提供的资料应由缔约国每年根据过去一个日历年的情况加以增补并至迟于每年4月30 日前向联合国秘书长提出报告。
3.3.
The Secretary-General of the United Nations shall transmit all such reports received to the States Parties.联合国秘书长应将收到的所有这种报告分送各缔约国。
Article 8.第8条.
Facilitation and Clarification of Compliance促进遵约和遵约澄清
1.1.
The States Parties agree to consult and cooperate with each other regarding the implementation of the provisions of this Convention, and to work together in a spirit of cooperation to facilitate compliance by States Parties with their obligations under this Convention.各缔约国同意就本公约各项规定的执行互相协商和合作,并以合作精神共同努力,促使各缔约国遵守本公约所规定的义务。
2.2.
If one or more States Parties wish to clarify and seek to resolve questions relating to compliance with the provisions of this Convention by another State Party, it may submit, through the Secretary-General of the United Nations, a Request for Clarification of that matter to that State Party.如果一个或多个缔约国希望澄清或试图解决有关另一个缔约国对本公约规定遵守情况的问题,可以通过联合国秘书长,就此事向该缔约国提出澄清请求。
Such a request shall be accompanied by all appropriate information.这种请求应附有一切适当的资料。

A State Party that receives a Request for Clarification shall provide, through the Secretary-General of the United Nations, within 28 days to the requesting State Party all information which would assist in clarifying this matter.收到澄清请求的缔约国应在28天内,通过联合国秘书长,向提出请求的缔约国提供有助于澄清此事的一切资料。
3.3.
If the requesting State Party does not receive a response through the Secretary-General of the United Nations within that time period, or deems the response to the Request for Clarification to be unsatisfactory, it may submit the matter through the Secretary-General of the United Nations to the next Meeting of the States Parties.如果提出请求的缔约国没有在上述时限内通过联合国秘书长收到答复,或者认为对澄清请求的答复未能令人满意,可以通过联合国秘书长,将此事提交下一次缔约国会议。

All such information shall be presented to the requested State Party which shall have the right to respond.所有这种资料应送交被请求的缔约国,该缔约国应有权作出答复。

Pending the convening of any meeting of the States Parties, any of the States Parties concerned may request the Secretary-General of the United Nations to exercise his or her good offices to facilitate the clarification requested.在任何缔约国会议召开之前,任何有关的缔约国可以请求联合国秘书长进行斡旋,促使有关方应请求作出澄清。
5. The requesting State Party may propose through the Secretary-General of the United Nations the convening of a Special Meeting of the States Parties to consider the matter.5.提出请求的缔约国可以通过联合国秘书长,提议召开一次缔约国特别会议来审议此事。
The Secretary-General of the United Nations shall thereupon communicate this proposal and all information submitted by the States Parties concerned, to all States Parties with a request that they indicate whether they favour a Special Meeting of the States Parties, for the purpose of considering the matter.联合国秘书长应立即将此提议以及有关的缔约国所提交的一切资料通报全体缔约国,并请它们表态是否赞成召开一次缔约国特别会议来审议此事。
In the event that within 14 days from the date of such communication, at least one-third of the States Parties favours such a Special Meeting, the Secretary-General of the United Nations shall convene this Special Meeting of the States Parties within a further 14 days.如果在发出上述通报后14天内,有至少三分之一的缔约国赞成召开特别会议,联合国秘书长即应在其后14天内召开缔约国特别会议。
A quorum for this Meeting shall consist of a majority of States Parties.这种会议的法定人数应为缔约国的半数。
6.6.
The Meeting of the States Parties or the Special Meeting of the States Parties, as the case may be, shall first determine whether to consider the matter further, taking into account all information submitted by the States Parties concerned.缔约国会议或缔约国特别会议(视情况而定)应首先根据有关的缔约国所提交的全部资料,决定是否进一步审议此事。
The Meeting of the States Parties or the Special Meeting of the States Parties shall make every effort to reach a decision by consensus.缔约国会议或缔约国特别会议应竭尽努力以协商一致方式作出决定。
If despite all efforts to that end no agreement has been reached, it shall take this decision by a majority of States Parties present and voting.如果竭尽了所有努力,仍然无法达成一致,则应以出席并参加表决的过半数缔约国以表决方式作出决定。
7.7.
All States Parties shall cooperate fully with the Meeting of the States Parties or the Special Meeting of the States Parties in the fulfilment of its review of the matter, including any fact-finding missions that are authorized in accordance with paragraph 8.所有缔约国均应同缔约国会议或缔约国特别会议充分合作,以完成对此事的审查,包括同按照第8款授权派出的任何实情调查团合作。
8.8.
If further clarification is required, the Meeting of the States Parties or the Special Meeting of the States Parties shall authorize a fact-finding mission and decide on its mandate by a majority of States Parties present and voting.如果需要作进一步澄清,缔约国会议或缔约国特别会议应以出席并参加表决的缔约国过半数,授权派出一个实情调查团,并决定它的职权范围。
At any time the requested State Party may invite a fact-finding mission to its territory.被请求的缔约国可以在任何时候邀请实情调查团前往该国领土。
Such a mission shall take place without a decision by a Meeting of the States Parties or a Special Meeting of the States Parties to authorize such a mission.这种调查团应无须经缔约国会议或缔约国特别会议作出授权决定即可派出。
The mission, consisting of up to 9 experts, designated and approved in accordance with paragraphs 9 and 10, may collect additional information on the spot or in other places directly related to the alleged compliance issue under the jurisdiction or control of the requested State Party.调查团应由按照第9和第10款指定和核准的最多9名专家组成,可以到现场或前往在被请求的缔约国管辖或控制下与被指控的遵约问题有直接关系的其他地点收集进一步资料。
9.9.
The Secretary-General of the United Nations shall prepare and update a list of the names, nationalities and other relevant data of qualified experts provided by States Parties and communicate it to all States Parties.联合国秘书长应编制和更新一份开列由缔约国提供的合格专家姓名、国籍和其他有关资料的名单,并将它通报给全体缔约国。
Any expert included on this list shall be regarded as designated for all fact-finding missions unless a State Party declares its non-acceptance in writing.列在这份名单上的任何专家应被视为获得指派参加所有实情调查团,除非某一缔约国书面表明不接受。
In the event of non-acceptance, the expert shall not participate in fact-finding missions on the territory or any other place under the jurisdiction or control of the objecting State Party, if the non-acceptance was declared prior to the appointment of the expert to such missions.假如某一专家不获接受,并且表示不接受的声明是在任命该专家参加调查团之前作出的,该名专家就不应参加派往表示反对的缔约国领土或在该国管辖或控制下的任何其他地点的实情调查团。
10.10.
Upon receiving a request from the Meeting of the States Parties or a Special Meeting of the States Parties, the Secretary-General of the United Nations shall, after consultations with the requested State Party, appoint the members of the mission, including its leader. Nationals of States Parties requesting the fact-finding mission or directly affected by it shall not be appointed to the mission.联合国秘书长接到缔约国会议或缔约国特别会议的请求后,应在同被请求的缔约国协商后,任命调查团的成员,包括其团长。不应任命请求派出实情调查团的缔约国或直接受它影响的缔约国的国民参加调查团。
The members of the fact-finding mission shall enjoy privileges and immunities under Article VI of the Convention on the Privileges and Immunities of the United Nations, adopted on 13 February 1946.实情调查团成员应享有1946年2月13日通过的《联合国特权和豁免公约》第六条所规定的特权和豁免。
11.11.
Upon at least 72 hours notice, the members of the fact-finding mission shall arrive in the territory of the requested State Party at the earliest opportunity. The requested State Party shall take the necessary administrative measures to receive, transport and accommodate the mission, and shall be responsible for ensuring the security of the mission to the maximum extent possible while they are on territory under its control.通知应至少提前72小时作出,此后,实情调查团成员应尽早进入被请求的缔约国领土。被请求的缔约国应采取必要的行政措施来接待调查团以及提供交通和食宿,并在调查团在其控制下的领土内逗留期间,应尽可能在最大程度上负责确保调查团的安全。
12.12.
Without prejudice to the sovereignty of the requested State Party, the fact-finding mission may bring into the territory of the requested State Party the necessary equipment which shall be used exclusively for gathering information on the alleged compliance issue.在不损害被请求的缔约国主权的情况下,实情调查团可以将只用于收集与所指控遵约问题有关资料的必要设备带进被请求的缔约国领土。
Prior to its arrival, the mission will advise the requested State Party of the equipment that it intends to utilize in the course of its fact-finding mission.调查团在抵达之前, 将把它在进行实情调查过程中打算使用的设备告知被请求的缔约国。
13.13.
The requested State Party shall make all efforts to ensure that the fact-finding mission is given the opportunity to speak with all relevant persons who may be able to provide information related to the alleged compliance issue.被请求的缔约国应尽其努力,确保给予实情调查团机会可以同也许能提供与被指控遵约问题有关资料的所有有关人士谈话。
14.14.
The requested State Party shall grant access for the fact-finding mission to all areas and installations under its control where facts relevant to the compliance issue could be expected to be collected.被请求的缔约国应允许实情调查团进入在其控制下的预期能收集到与遵约问题有关的事实情况的所有地区和设施。
This shall be subject to any arrangements that the requested State Party considers necessary for:这应受到被请求的缔约国因下述理由认为有必要作出的任何安排的限制:

The physical protection and safety of the members of the fact-finding mission.保护实情调查团成员的人身和安全。
In the event that the requested State Party makes such arrangements, it shall make every reasonable effort to demonstrate through alternative means its compliance with this Convention.被请求的缔约国如果作出这种安排,应作出一切合理的努力,通过替代方式表明它遵守了本公约。
15.15.
The fact-finding mission may remain in the territory of the State Party concerned for no more than 14 days, and at any particular site no more than 7 days, unless otherwise agreed.除非另有协议,否则实情调查团在有关的缔约国领土内逗留不得超过14天, 在任何一个特定地点逗留不得超过7天。
16.16.
All information provided in confidence and not related to the subject matter of the fact-finding mission shall be treated on a confidential basis.作为机密提供的与实情调查团主要任务无关的一切资料,应视为机密资料处理。
17.17.
The fact-finding mission shall report, through the Secretary-General of the United Nations, to the Meeting of the States Parties or the Special Meeting of the States Parties the results of its findings.实情调查团应通过联合国秘书长,向缔约国会议或缔约国特别会议报告其调查结果。
18.18.
The Meeting of the States Parties or the Special Meeting of the States Parties shall consider all relevant information, including the report submitted by the fact-finding mission, and may request the requested State Party to take measures to address the compliance issue within a specified period of time. The requested State Party shall report on all measures taken in response to this request.缔约国会议或缔约国特别会议应审议一切有关的资料,包括实情调查团所提交的报告,并可以请被请求的缔约国采取措施,在特定期限内解决遵约问题。被请求的缔约国应就它应此项请求采取的所有措施提出报告,
19.19.
The Meeting of the States Parties or the Special Meeting of the States Parties may suggest to the States Parties concerned ways and means to further clarify or resolve the matter under consideration, including the initiation of appropriate procedures in conformity with international law.缔约国会议或缔约国特别会议可以向有关的缔约国建议进一步澄清或解决审议中的事项的方法和方式,包括依照国际法开始适当的程序。
In circumstances where the issue at hand is determined to be due to circumstances beyond the control of the requested State Party, the Meeting of the States Parties or the Special Meeting of the States Parties may recommend appropriate measures, including the use of cooperative measures referred to in Article 6.如果判断定该问题源自被请求的缔约国无法控制的情祝,缔约国会议或缔约国特别会议可以建议采取适当的措施,包括采用第6条所述的合作措施。
20.20.
The Meeting of the States Parties or the Special Meeting of the States Parties shall make every effort to reach its decisions referred to in paragraphs 18 and 19 by consensus, otherwise by a two-thirds majority of States Parties present and voting.缔约国会议或缔约国特别会议应竭尽努力以协商一致方式达成第18和19款所述的决定,否则应以出席并参加表决的缔约国三分之二多数作出这种决定。
Article 9.第9条.
National Implementation Measures国家执行措施
Each State Party shall take all appropriate legal, administrative and other measures, including the imposition of penal sanctions, to prevent and suppress any activity prohibited to a State Party under this Convention undertaken by persons or on territory under its jurisdiction or control.每一缔约国应采取一切适当的法律、行政和其他措施,包括实施刑事制裁,以防止和制止任何人在其管辖或控制下或者在受其管辖或控制的领土上从事本公约禁止缔约国进行的任何活动。
Article 10.第10条.
Settlement of Disputes争议的解决
1. The States Parties shall consult and cooperate with each other to settle any dispute that may arise with regard to the application or the interpretation of this Convention.缔约国应互相协商和合作解决任何可能因本公约的适用或解释发生的争议。
Each State Party may bring any such dispute before the Meeting of the States Parties.每一缔约国均可将任何这种争议提交缔约国会议处理。
2.2
The Meeting of the States Parties may contribute to the settlement of the dispute by whatever means it deems appropriate, including offering its good offices, calling upon the States Parties to a dispute to start the settlement procedure of their choice and recommending a time-limit for any agreed procedure.缔约国会议可以采取它认为适当的任何方式促成争议的解决,包括进行斡旋、促请争议各当事缔约国进行其选择的解决程序以及为任何议定的程序建议一个时限。

Article 11.第11条.
Meetings of the States Parties缔约国会议
1. The States Parties shall meet regularly in order to consider any matter with regard to the application or implementation of this Convention, including:1.缔约国应定期开会,以便审议有关本公约的适用或执行的任何事项,包括:

(d) The development of technologies to clear anti-personnel mines;(d) 清除杀伤人员地雷技术的发展;
(e) Submissions of States Parties under Article 8; and(e) 缔约国根据第8条提出的请求;和
(f) Decisions relating to submissions of States Parties as provided for in Article 5.(f) 就缔约国根据第5条规定提出请求作出的决定。
2.2
The First Meeting of the States Parties shall be convened by the Secretary-General of the United Nations within one year after the entry into force of this Convention.第一次缔约国会议应由联合国秘书长在本公约生效后一年内召开。
The subsequent meetings shall be convened by the Secretary-General of the United Nations annually until the first Review Conference.以后的会议应每年由联合国秘书长召开,直至第一次审议会议召开为止。
3.3.
Under the conditions set out in Article 8, the Secretary-General of the United Nations shall convene a Special Meeting of the States Parties.联合国秘书长应按照第8条所列的条件召开缔约国特别会议。
4.4.
States not parties to this Convention, as well as the United Nations, other relevant international organizations or institutions, regional organizations, the International Committee of the Red Cross and relevant non-governmental organizations may be invited to attend these meetings as observers in accordance with the agreed Rules of Procedure.非本公约缔约国的国家,以及联合国、其他有关国际组织或机构、区域组织、 红十字国际委员会和有关的非政府组织,可以按照议定的《议事规则》被邀请作为观察员出席这些会议。
Article 12. Review Conferences第12条.审议会议
1. A Review Conference shall be convened by the Secretary-General of the United Nations five years after the entry into force of this Convention. Further Review Conferences shall be convened by the Secretary-General of the United Nations if so requested by one or more States Parties, provided that the interval between Review Conferences shall in no case be less than five years. All States Parties to this Convention shall be invited to each Review Conference.1.审议会议应由联合国秘书长在本公约生效五年后召开。此后的审议会议应在一个或多个缔约国提出请求时由联合国秘书长召开,但两次审议会议之间的间隔无论如何不应少于五年。每一次审议会议均应邀请本公约的全体缔约国参加。
2. The purpose of the Review Conference shall be:2.审议会议的目的应为:
(a) To review the operation and status of this Convention;(a) 审议本公约的实施情况和现状;
(b) To consider the need for and the interval between further Meetings of the States Parties referred to in paragraph 2 of Article 11;(b) 审议第11条第2款所述以后召开缔约国会议的需要和时间间隔;
(c) To take decisions on submissions of States Parties as provided for in Article 5; and(c)就缔约国根据第5条规定提出的请求作出决定;和
(d) To adopt, if necessary, in its final report conclusions related to the implementation of this Convention.(d)必要时在其最后报告中通过关于本公约执行情况的结论。
3.3.
States not parties to this Convention, as well as the United Nations, other relevant international organizations or institutions, regional organizations, the International Committee of the Red Cross and relevant non-governmental organizations may be invited to attend each Review Conference as observers in accordance with the agreed Rules of Procedure.非本公约缔约国的国家,以及联合国,其他有关国际组织或机构、区域组织、红十字国际委员会和有关的非政府组织,可以按照议定的《议事规则》被邀请作为观察员出席每一次审议会议。
Article 13. Amendments第13条.修正
1. At any time after the entry into force of this Convention any State Party may propose amendments to this Convention. Any proposal for an amendment shall be communicated to the Depositary, who shall circulate it to all States Parties and shall seek their views on whether an Amendment Conference should be convened to consider the proposal. If a majority of the States Parties notify the Depositary no later than 30 days after its circulation that they support further consideration of the proposal, the Depositary shall convene an Amendment Conference to which all States Parties shall be invited.1.任何缔约国可以在本公约生效后随时对本公约提出修正。任何修正案均应送交保存人;保存人应将其分送所有缔约国,并应征求它们对于应否召开一次修约会议来审议该提案的意见。如果过半数缔约国在提案分送后30天以内通知保存人表示赞成进一步审议该提案,保存人应召开一次修约会议,并应邀请所有缔约国参加。
2. States not parties to this Convention, as well as the United Nations, other relevant international organizations or institutions, regional organizations, the International Committee of the Red Cross and relevant non-governmental organizations may be invited to attend each Amendment Conference as observers in accordance with the agreed Rules of Procedure.2.非本公约缔约国的国家,以及联合国、其他有关国际组织或机构、区域组织、红十字国际委员会和有关的非政府组织,可以按照议定的《议事规则》被邀请作为观察员出席每一次修约会议。
3.3.
The Amendment Conference shall be held immediately following a Meeting of the States Parties or a Review Conference unless a majority of the States Parties request that it be held earlier.修约会议应紧接缔约国会议或审议会议之后举行,除非过半数缔约国请求提早举行。
4.4.
Any amendment to this Convention shall be adopted by a majority of two-thirds of the States Parties present and voting at the Amendment Conference.对本公约的任何修正应以出席修约会议并参加表决的缔约国三分之二多数通过。
The Depositary shall communicate any amendment so adopted to the States Parties.保存人应将以此方式获得通过的任何修正通报各缔约国。
5.5.
An amendment to this Convention shall enter into force for all States Parties to this Convention which have accepted it, upon the deposit with the Depositary of instruments of acceptance by a majority of States Parties. Thereafter it shall enter into force for any remaining State Party on the date of deposit of its instrument of acceptance.对本公约的修正应在过半数缔约国向保存人交存接受书后,对所有已表示接受该项修正的本公约缔约国生效。其后,对于任何其余的缔约国,修正应从该国交存接受书之日起生效。
Article 14. Costs第14条.费用
1.1.
The costs of the Meetings of the States Parties, the Special Meetings of the States Parties, the Review Conferences and the Amendment Conferences shall be borne by the States Parties and States not parties to this Convention participating therein, in accordance with the United Nations scale of assessment adjusted appropriately.缔约国会议、缔约国特别会议、审议会议和修约会议的费用,应由参加会议的本公约缔约国和非缔约国按适当调整的联合国会费分摊比额分摊。
2.2.
The costs incurred by the Secretary-General of the United Nations under Articles 7 and 8 and the costs of any fact-finding mission shall be borne by the States Parties in accordance with the United Nations scale of assessment adjusted appropriately.联合国秘书长因执行第7条和第8条而产生的费用,以及任何实情调查团的费用,应由缔约国按适当调整的联合国会费分摊比额分摊。
Article 15.第15条 签署
Signature This Convention, done at Oslo, Norway, on 18 September 1997, shall be open for signature at Ottawa, Canada, by all States from 3 December 1997 until 4 December 1997, and at the United Nations Headquarters in New York from 5 December 1997 until its entry into force.本公约于1997年9月18 日在挪威奥斯陆签订,应于1997年12月3日至1997年12月4日在加拿大渥太华,并自1997年12月5日起在纽约联合国总部开放给所有国家签署,直至公约生效为止。
Article 16. Ratification, Acceptance, Approval or Accession第16条.批准、接受、核准或加入
1.1.
This Convention is subject to ratification, acceptance or approval of the Signatories.本公约须经各签署国批准、接受或核准。
2.2.
It shall be open for accession by any State which has not signed the Convention.本公约应开放供未签署本公约的任何国家加入。
3.3.
The instruments of ratification, acceptance, approval or accession shall be deposited with the Depositary.批准书、接受书、核准书或加入书应交存于保存人。
Article 17. Entry into Force第17条.生效
1.1.
This Convention shall enter into force on the first day of the sixth month after the month in which the 40th instrument of ratification, acceptance, approval or accession has been deposited.本公约应自第40份批准书、接受书、核准书或加入书交存之月第六个月的第一天起生效。
2.2.
For any State which deposits its instrument of ratification, acceptance, approval or accession after the date of the deposit of the 40th instrument of ratification, acceptance, approval or accession, this Convention shall enter into force on the first day of the sixth month after the date on which that State has deposited its instrument of ratification, acceptance, approval or accession.对于在第40份批准书、接受书、核准书或加入书交存之日后交存其批准书、接受书,核准书或加入书的任何国家,本公约应自该国交存其批准书、接受书、核准书或加入书之日后第六个月的第一天起生效。
Article 18.第18条.
Provisional Application临时适用
Any State may at the time of its ratification, acceptance, approval or accession, declare that it will apply provisionally paragraph 1 of Article 1 of this Convention pending its entry into force.任何国家可以在批准、接受、核准或加入本公约时宣布,在本公约生效之前,它将临时实施本公约第1条第1款。
Article 19. Reservations第19条.保留
The Articles of this Convention shall not be subject to reservations.不得对本公约的条款作出保留。
Article 20.第20条.
Duration and Withdrawal期限和退出
1.1.
This Convention shall be of unlimited duration.本公约应无限期有效。
2.2.
Each State Party shall, in exercising its national sovereignty, have the right to withdraw from this Convention.每一缔约国为行使国家主权,有权退出本公约。
It shall give notice of such withdrawal to all other States Parties, to the Depositary and to the United Nations Security Council.它应将退约一事通知所有其他缔约国、保存人和联合国安全理事会。
Such instrument of withdrawal shall include a full explanation of the reasons motivating this withdrawal.退出书中应对引起退约的理由作出充分说明。
3.3.
Such withdrawal shall only take effect six months after the receipt of the instrument of withdrawal by the Depositary.退约应在保存人收到退出书六个月后生效。
If, however, on the expiry of that six-month period, the withdrawing State Party is engaged in an armed conflict, the withdrawal shall not take effect before the end of the armed conflict.但是,如果在六个月期满时,退出的缔约国正处于武装冲突之中,则退约不应在武装冲突结束之前生效。
4.4.
The withdrawal of a State Party from this Convention shall not in any way affect the duty of States to continue fulfilling the obligations assumed under any relevant rules of international law.某一缔约国退出本公约,不应在任何意义上影响各国继续履行它们在任何有关国际法规则下所承担义务的责任。
Article 21.Depositary第21条.保存人
The Secretary-General of the United Nations is hereby designated as the Depositary of this Convention.兹指定联合国秘书长为本公约的保存人。
Article 22. Authentic Texts第22条.作准文本
The original of this Convention, of which the Arabic, Chinese, English, French, Russian and Spanish texts are equally authentic, shall be deposited with the Secretary-General of the United Nations.本公约正本应交存于联合国秘书长,其阿拉伯文、中文、英文、法文,俄文和西班牙文文本同等作准。
